According to the Court's well-established case-law, proceedings in a Constitutional Court are to be taken into account for calculating the relevant period where the result of such proceedings is capable of affecting the outcome of the dispute before the ordinary courts (see, inter alia, the Deumeland v. Germany judgment of 29 May 1986, Series A no. 100, p. 26, para. 77, the Poiss v. Austria judgment of 23 April 1987, Series A no. 117, p. 103, para. 52, and the Bock v. Germany judgment of 29 March 1989, Series A no. 150, p. 18, para. 37).As to the question whether the right in issue was a "civil" right, the relevant criterion is in my view that which the Court applied in paragraph 35 of the judgment in order to determine the period to be taken into consideration as regards compliance with the "reasonable time" requirement, namely the potentially decisive influence of the Constitutional Court's decision on the outcome of the civil proceedings (see the Bock v. Germany judgment of 29 March 1989, Series A no. 150, p. 18, para. 37).

Die Umsetzung der Richtlinie in das portugiesische Recht erfolgte hinsichtlich des IRC durch das Decreto-Lei Nr. 123/92 vom 2. Juli 1992 ( Diário da República I, Serie A, Nr. 150, S. 3148), durch das Artikel 69 Absatz 2 Buchstabe c des Código do Imposto sobre o Rendimento das Pessoas Colectivas (Körperschaftsteuergesetz) wie folgt neu gefaßt wurde: "Bei Einkünften von juristischen Personen, die weder ihren Sitz noch ihre tatsächliche Leitung im portugiesischen Hoheitsgebiet haben und die dort auch keine feste Niederlassung besitzen, der diese Einkünfte zugerechnet werden können, beträgt der IRC-Satz 25 %, außer bei folgenden Einkünften: ... c) den Gewinnen, die eine juristische Person, die im portugiesischen Hoheitsgebiet ansässig ist und den in Artikel 2 der Richtlinie 90/435/EWG vom 23. Juli 1990 festgelegten Bedingungen genügt, an eine in einem anderen Mitgliedstaat der Europäischen Gemeinschaften ansässige juristische Person ausschüttet, die sich in derselben Lage befindet und während zweier aufeinanderfolgender Jahre oder seit der Gründung der erstgenannten Gesellschaft an deren Kapital eine direkte Beteiligung von nicht weniger als 25 % hält, vorausgesetzt, daß im letzteren Fall die Beteiligung während dieses Zeitraums aufrechterhalten wird, wobei der IRC-Satz unbeschadet der Bestimmungen geltender bilateraler Abkommen biszum 31. 1 (art. 6-1) also applied to the examination of Mr Kraska's public-law appeal, the Court reiterates that proceedings come within the scope of this provision, even if they are conducted before a constitutional court, where their outcome is decisive for civil rights and obligations (see, inter alia, the Ringeisen v. ELLERSIEK v. GERMANY
As the Court has held in the Bock case (Bock v. Germany, judgment of 29 March 1989, Series A no. 150, § 44), an error by a Court leading to a delay in the proceedings brought about by the need for appeal proceedings to correct the error may, in combination with other factors, be taken into account in the determination of the reasonableness of the relevant period pursuant to Article 6 § 1. V.K. v. CROATIA
The Court would also reiterate that particular diligence is required in cases concerning civil status and capacity (see Bock v. Germany, judgment of 29 March 1989, Series A no. 150, p. 23, § 49) and that the competent national authorities are required by Article 6 § 1 to act with particular diligence in ensuring the progress of the proceedings (see Mikulic v.
