Erfolglose Verfassungsbeschwerde gegen Ausweisung nach Tunesien
Daraus folgt, dass für einen zu lebenslanger Freiheitsstrafe Verurteilten bereits im Zeitpunkt der Verhängung der Strafe sowohl eine Aussicht auf Freilassung als auch eine Möglichkeit der Überprüfung der Haft bestehen muss (vgl. EGMR, Urteile vom 9. Juli 2013 - 66069/09 et al. -, Vinter/Großbritannien, Rn. 109;… vom 26. April 2016 - 10511/10 -, Murray/Niederlande, Rn. 99 …und vom 17. Januar 2017 - 57592/08 -, Hutchinson/Großbritannien, Rn. 42).Ein Verstoß gegen Art. 3 EMRK kann bereits dann vorliegen, wenn die lebenslange Freiheitsstrafe entweder de jure (vgl. EGMR, Urteil vom 9. Juli 2013 - 66069/09 et al. -, Vinter/Großbritannien, Rn. 123 ff.) oder de facto (vgl. EGMR…, Urteil vom 26. April 2016 - 10511/10 -, Murray/Niederlande, Rn. 113 ff.) nicht herabsetzbar ist.
(2) Ein Verurteilter hat das Recht, bereits bei Verhängung der Strafe zu wissen, was er tun muss, um für eine Freilassung in Betracht zu kommen und unter welchen Bedingungen eine Überprüfung seiner Strafe erfolgen wird (vgl. EGMR, Urteil vom 9. Juli 2013 - 66069/09 et al. -, Vinter/Großbritannien, Rn. 122).
(4) Der Europäische Gerichtshof für Menschenrechte hat die Bedeutung der fortgeltenden Strafzwecke (…vgl. EGMR, Urteile vom 17. Januar 2012 - 9146/07 et al. -, Harkins und Edwards/Großbritannien, Rn. 137 f.;… vom 10. April 2012 - 24027/07 et al. -, Babar Ahmad/Großbritannien, Rn. 241 f.;… vom 4. September 2014 - 140/10 -, Trabelsi/Belgien, Rn. 124 …und vom 17. Januar 2017 - 57592/08 -, Hutchinson/Großbritannien, Rn. 42) und die Menschenwürde (vgl. EGMR, Urteile vom 9. Juli 2013 - 66069/09 et al. -, Vinter/Großbritannien, Rn. 113 …und vom 26. April 2016 - 10511/10 -, Murray/Niederlande, Rn. 101) als wesentliche, bei der von Art. 3 EMRK geforderten Überprüfung einer lebenslangen Freiheitsstrafe zu berücksichtigende Kriterien hervorgehoben.

Relying on its previous judgment in R v. Bieber (see paragraph 40 below), it found that no issue arose under Article 3 of the Convention as the whole life order was not an irreducible life sentence as that term had been used in Kafkaris v. Cyprus [GC], no. 21906/04, ECHR 2008-... Finally, following its ruling in R v. Pitchfork (see paragraph 41 below) it found that the review procedure created by the 2003 Act was compatible with Article 7 of the Convention as, properly construed, the relevant statutory provisions meant a prisoner could not be disadvantaged by the outcome of the review: the term to be served could be reduced, or maintained, but it could not be increased or extended.In R v. Bieber [2009] 1 WLR 223 the Court of Appeal considered the compatibility of the 2003 Act with Article 3 of the Convention in the light of Kafkaris v. Cyprus [GC], no. 21906/04, ECHR 2008-.
As the Court pointed out in Kafkaris v. Cyprus [GC], no. 21906/04, § 97, ECHR 2008-..., a sentence of life imprisonment "is not in itself prohibited by or incompatible with Article 3".

They considered that, although the substantive issue of an irreducible life sentence fell to be considered under Article 3, procedurally the need to review such a sentence fell under Article 5 § 4. If Article 3 required review of fitness for conditional release, then, as with other powers to review the legality of indeterminate sentences, such a review required the procedural protections of Article 5 § 4, as in Stafford v. the United Kingdom [GC], no. 46295/99, ECHR 2002-IV. Cyprus (no. 21906/04, ECHR 2008).

The relevant texts of the Council of Europe, the European Union and other international legal texts on the imposition and review of sentences of life imprisonment are set out in Kafkaris v. Cyprus ([GC], no. 21906/04, §§ 68-76, ECHR 2008), Vinter and Others v. the United Kingdom ([GC], nos. 66069/09, 130/10 and 3896/10, §§ 60-75, 9 July 2013), and most recently Murray v. the Netherlands [GC], 10511/10, §§ 58-65, 26 April 2016).Furthermore, the applicants complained that, under the new procedure, they could apply for release only after forty years, a term which fell foul of the Court's findings in Vinter and Others v. the United Kingdom ([GC], nos. 66069/09, 130/10 and 3896/10, ECHR 2013 (extracts)), which indicated that States should guarantee the review of life sentences after no longer than twenty five years in order to guarantee the possibility, de iure and de facto, of a release on parole, should the proper conditions be met.
On the surface, this opinion may seem to be in some disagreement with the Court's case-law, as expounded in 2013 in Vinter and Others v. the United Kingdom ([GC], nos. 66069/09, 130/10 and 3896/10, ECHR 2013 (extracts)) and just a few months ago in Murray v. the Netherlands ([GC], 10511/10, §§ 58-65, 26 April 2016).

À cet égard, la jurisprudence administrative a évolué sous l'influence de celle de la Cour (voir en ce sens les conclusions du rapporteur public prises pour la décision du 9 novembre 2015 citée ci-dessous, qui renvoie aux arrêts Vinter et autres c. Royaume-Uni [GC], nos 66069/09 et 2 autres, § 119, CEDH 2013 (extraits), voir paragraphe 93 ci-dessous, et Öcalan c. Turquie (no 2), nos 24069/03 et 3 autres, 18 mars 2014).Dans cet arrêt, la Cour a notamment rappelé les principes dégagés dans l'affaire Vinter et autres c. Royaume Uni ([GC], no 66069/09 et 2 autres, §§ 104-122, CEDH 2013 (extraits)), qui ont vocation à s'appliquer dans un contexte interne, lorsque la situation du requérant, qui a déjà été jugé coupable et condamné, est connue.

En réaction à la référence faite à la jurisprudence Vinter et autres c. Royaume-Uni [GC] (nos 66069/09, 130/10 et 3896/10, CEDH 2013 (extraits)) lors de la communication de l'affaire, le Gouvernement souligne qu'on ne saurait assimiler la situation d'une personne internée à une réclusion à perpétuité.
