  • EGMR, 03.10.2017 - 45083/06

NOVAYA GAZETA AND MILASHINA v. RUSSIA

    Auszug aus EGMR, 04.12.2018 - 11257/16
In connection to the question of repetition, the Court reiterates that "punishment of a journalist for assisting in the dissemination of statements made by another person in an interview would seriously hamper the contribution of the press to discussion of matters of public interest and should not be envisaged unless there are particularly strong reasons for doing so" (see Jersild v. Denmark, 23 September 1994, § 35, Series A no. 298; Thoma v. Luxembourg, no. 38432/97, § 62, ECHR 2001-III § 62; and Novaya Gazeta and Milashina v. Russia, no. 45083/06, § 71, 3 October 2017).

[21] For example, paragraph 80 of the judgment, while referring to the liability of the hyperlinker, refers explicitly to the liability criteria set out for the traditional print media in Novaya Gazeta and Milashina v. Russia, no. 45083/06, § 72, 3 October 2017.

    News-Portal: Keine Haftung für Nutzerkommentare

    Auszug aus EGMR, 04.12.2018 - 11257/16
Although Internet news portals are not publishers of third-party comments in the traditional sense, they can assume responsibility under certain circumstances for user-generated content (see Magyar Tartalomszolgáltatók Egyesülete and Index.hu Zrt v. Hungary, no. 22947/13, § 62, 2 February 2016).

    JERSILD v. DENMARK

LINDON, OTCHAKOVSKY-LAURENS ET JULY c. FRANCE

    Auszug aus EGMR, 04.12.2018 - 11257/16
Unlike the latter, the former inevitably and knowingly lays himself open to close scrutiny of his or her every word and deed by both journalists and the public at large, and he or she must consequently display a greater degree of tolerance (see Lindon, Otchakovsky-Laurens and July v. France [GC], nos. 21279/02 and 36448/02, § 46, ECHR 2007-IV).
  • BGH, 14.10.2010 - I ZR 191/08

    AnyDVD

    Auszug aus EGMR, 04.12.2018 - 11257/16
The German Federal Court also held that "it is generally permitted to report on statements that illegally impair third parties" rights of personality, despite the perpetuation or even amplification of the initial violation by means of the dissemination, if there is a predominant interest in the information and the disseminator does not appropriate the reported statements as his/her own" (German Federal Court, I ZR 191/08, 14 October 2010).

  • EGMR, 18.12.2012 - 3111/10

    Menschenrechtsgerichtshof verurteilt Türkei wegen Online-Zensur

    Auszug aus EGMR, 04.12.2018 - 11257/16
As regards the importance of Internet sites in the exercise of freedom of expression the Court has found that in the light of its accessibility and its capacity to store and communicate vast amounts of information, the Internet has played an important role in enhancing the public's access to news and facilitating the dissemination of information in general (see Ahmet Yildirim v. Turkey, no. 3111/10, § 48, ECHR 2012).

    Auszug aus EGMR, 04.12.2018 - 11257/16
Indeed, such a person, by making that work available to the public by providing other internet users with direct access to it (see, to that effect, judgment of 13 February 2014, Svensson and Others, C-466/12, EU:C:2014:76, paragraphs 18 to 23) does not, as a general rule, intervene in full knowledge of the consequences of his conduct in order to give customers access to a work illegally posted on the internet.
  • EGMR, 17.05.2016 - 42461/13

    KARÁCSONY ET AUTRES c. HONGRIE

    Auszug aus EGMR, 04.12.2018 - 11257/16
The Court has found that persons carrying on a professional activity, who are used to having to proceed with a high degree of caution when pursuing their occupation, can on this account be expected to take special care in assessing the risks that such activity entails (see Karácsony and Others v. Hungary [GC], nos. 42461/13 and 44357/13, §§ 123-125, ECHR 2016 (extracts), and the cases cited therein).

    Auszug aus EGMR, 04.12.2018 - 11257/16
In the judgment no. 1 BvR 1248/11 of 15 December 2011 the German Federal Constitutional Court pointed out that the provision of a link in an online article was protected under the German Basic Law.
  • BGH, 27.07.2020 - VI ZR 476/18

    Auslistungsbegehren gegen Google

EuGH, Urteil vom 29. Juli 2019 - Rs. C-516/17, AfP 2019, 424, 432 Rn. 81; vom 7. August 2018 - C-161/17, NJW 2018, 3501, 3503 Rn. 40; vom 8. September 2016 - Rs. C-160/15, NJW 2016, 3149, 3152 Rn. 45; EGMR, NJW 2019, 3201, 3203 Rn. 73 ff.; NJW 2017, 2091, 2093 Rn. 56).

    ALMEIDA ARROJA v. PORTUGAL

They have been summarised in, among other cases, Bédat v. Switzerland ([GC], no. 56925/08, §§ 48-54, 29 March 2016), and Magyar Jeti Zrt v. Hungary (no. 11257/16, §§ 63-68, 4 December 2018).

Hongrie, no 11257/16, §§ 73-74, 4 décembre 2018).
  • EGMR, 11.05.2021 - 10271/12

    KILIN v. RUSSIA

For instance, the Court has previously stated that the prosecution for posting a hyperlink to defamatory material online amounted to an "interference" under Article 10 of the Convention (see Magyar Jeti Zrt v. Hungary, no. 11257/16, § 56, 4 December 2018).
  • EGMR, 07.06.2022 - 42713/15

PATRÍCIO MONTEIRO TELO DE ABREU c. PORTUGAL

Hongrie, no 11257/16, § 81, 4 décembre 2018).
  • EGMR, 08.09.2020 - 22649/08

    OOO REGNUM v. RUSSIA

At the same time, the risk of harm posed by content and communications on the Internet to the exercise and enjoyment of human rights and freedoms, particularly the right to respect for private life, is certainly higher than that posed by the press (ibid., § 133; see also Arnarson v. Iceland, no. 58781/13, § 37, 13 June 2017, and Magyar Jeti Zrt v. Hungary, no. 11257/16, § 66, 4 December 2018).
  • EGMR, 11.05.2021 - 44561/11

RID NOVAYA GAZETA AND ZAO NOVAYA GAZETA v. RUSSIA

The Court has considered that "punishment of a journalist for assisting in the dissemination of statements made by another person in an interview would seriously hamper the contribution of the press to discussion of matters of public interest and should not be envisaged unless there are particularly strong reasons for doing so" (see Jersild, cited above, § 35, and, subsequently in the defamation context, Pedersen and Baadsgaard v. Denmark [GC], no. 49017/99, § 77, ECHR 2004-XI, and Magyar Jeti Zrt v. Hungary, no. 11257/16, § 80, 4 December 2018).

GORRAIZ LIZARRAGA ET AUTRES c. ESPAGNE

    Auszug aus EGMR, 04.12.2018 - 234/15
According to the Court's established case-law, the concept of "victim" must be interpreted autonomously and irrespective of domestic concepts such as those concerning an interest or capacity to act (see Gorraiz Lizarraga and Others v. Spain, no. 62543/00, § 35, ECHR 2004-III).

    Auszug aus EGMR, 04.12.2018 - 234/15
For it to be compatible with the Convention, a limitation of that right must, in particular, pursue an aim that can be linked to one of those listed in that provision (see S.A.S. v. France [GC], no. 43835/11, § 113, ECHR 2014 (extracts)).
