As the requirements of paragraph 3 of Article 6 (art. 6-3) are to be seen as particular aspects of the right to a fair trial guaranteed by paragraph 1, the Court will examine the complaints under both provisions taken together (see, as the most recent authority, the Poitrimol v. France judgment of 23 November 1993, Series A no. 277-A, p. 13, para. 29).In its judgment the Court has made several references to the Poitrimol v. France judgment of 23 November 1993, Series A no. 277-A.
It is only in criminal cases of some seriousness that the interests of justice may require that the accused should always be present or represented, if need be by counsel assigned officially (see, mutatis mutandis, the Kremzow v. Austria judgment of 21 September 1993, Series A no. 268-B, pp. 44-45, paras. 65-69, and the Poitrimol v. France judgment of 23 November 1993, Series A no. 277-A).

Allerdings habe der Europäische Gerichtshof für Menschenrechte gegen andere Vertragsstaaten der Konvention Urteile erlassen, welche die Konstellation des Ausbleibens eines Angeklagten bei Anwesenheit eines verteidigungsbereiten Anwalts in der Hauptverhandlung zum Gegenstand hatten (siehe Poitrimol ./. Frankreich, 23. November 1993, Serie A Band 277-A; Lala ./. Niederlande, 22. September 1994, Serie A Band 297-A; Pelladoah ./. Niederlande, 22. September 1994, Serie A Band 297-B; Van Geyseghem ./. Belgien [GK], Individualbeschwerde Nr. 26103/95, ECHR 1999-I; und Krombach ./. Frankreich, Individualbeschwerde Nr. 29731/96, ECHR 2001-II).Weder das Bundesverfassungsgericht noch die Regierung hätten dargelegt, dass sich der in Rede stehende Sachverhalt der vorliegenden Individualbeschwerde von den bereits vom Gerichtshof entschiedenen Konstellationen, z. B. in den Rechtssachen Poitrimol ./. Frankreich (23. November 1993, Serie A Band 277-A), Lala ./. Niederlande (22. September 1994, Serie A Band 297-A), Van Geyseghem ./. Belgien ([GK], Individualbeschwerde Nr. 26103/95, ECHR 1999-I), Krombach ./. Frankreich (Individualbeschwerde Nr. 29731/96, ECHR 2001-II) und Kari-Pekka Pietiläinen ./. Finnland (Individualbeschwerde Nr. 13566/06, 22. September 2009) unterscheide, in denen der Gerichtshof einen Verstoß gegen Artikel 6 Absatz 1 und Absatz 3 Buchstabe c der Konvention festgestellt habe.
Dies gilt grundsätzlich auch bei einer Neuverhandlung im Berufungsrechtszug (siehe u. a. Lala ./. Niederlande, 22. September 1994, Rdnr. 33, Serie A Band 297-A;… und Pelladoah ./. Niederlande, 22. September 1994, Rdnr. 40, Serie A Band 297-B).

In the interests of a fair and just criminal process it is of capital importance that the accused should appear at his trial (see Lala v. the Netherlands, 22 September 1994, § 33, Series A no. 297-A; Poitrimol v. France, 23 November 1993, § 35, Series A no. 277-A; and De Lorenzo v. Italy (dec.), no. 69264/01, 12 February 2004), and the duty to guarantee the right of a criminal defendant to be present in the courtroom - either during the original proceedings or in a retrial - ranks as one of the essential requirements of Article 6 (see Stoichkov v. Bulgaria, no. 9808/02, § 56, 24 March 2005).As paragraph 58 of the judgment rightly points out: "In the interests of a fair and just criminal process it is of capital importance that the accused should appear at his trial (see Lala v. the Netherlands, 22 September 1994, § 33, Series A no. 297-A; Poitrimol v. France, 23 November 1993, § 35, Series A no. 277-A; and De Lorenzo v. Italy (dec.), no. 69264/01, 12 February 2004), and the duty to guarantee the right of a criminal defendant to be present in the courtroom - either during the original proceedings or in a retrial - ranks as one of the essential requirements of Article 6 (see Stoichkov v. The applicant, relying on the Court's Lala v. the Netherlands judgment of 22 September 1994 (Series A no. 297-A), argued that the Court of Appeal ought to have referred the case back to the Regional Court for a rehearing at first instance.

La présente affaire se distingue des affaires Poitrimol (arrêt précité), Lala et Pelladoah c. Pays-Bas (arrêts du 22 septembre 1994, série A no 297-A et B), Van Geyseghem et Krombach (arrêts précités), en ce que l'absence du requérant n'a pas été sanctionnée en dérogeant au droit à l'assistance d'un défenseur.Certes, la Cour a développé une jurisprudence « négative ", constatant des violations dans des affaires où les juridictions internes, en l'absence du défendeur, avaient privé celui-ci de son droit à être dûment représenté par un avocat (voir l'arrêt récent de la troisième section de la Cour dans l'affaire Van Pelt c. France, no 31070/96, 23 mai 2000, non publié, qui fait suite aux affaires Lala et Pelladoah c. Pays-Bas, arrêts du 22 septembre 1994, série A no 297-A et B).
