The President of the Court, Mr L. Nach dieser Rechtsprechung sind Äußerungen, mit denen Gewalt, Hass, Fremdenfeindlichkeit oder andere Formen der Intoleranz verteidigt oder gerechtfertigt werden, anders als die besonders schützenswerten Äußerungen zu Fragen von öffentlichem Interesse in der Regel nicht geschützt (vgl. in diesem Sinne EGMR, 8. Juli 1999, Sürek/Türkei [Nr. 1], CE:ECHR:1999:0708JUD002668295, §§ 61 und 62, und 15. Oktober 2015, Perinçek/Schweiz, CE:ECHR:2015:1015JUD002751008, §§ 197 und 230).Insoweit ist im Übrigen darauf hinzuweisen, dass nach der Rechtsprechung des EGMR der Herausgeber, soweit er befugt ist, die redaktionelle Linie vorzugeben, mittelbar die den Redakteuren und Journalisten bei der Sammlung und öffentlichen Verbreitung von Informationen obliegenden "Pflichten und Verantwortlichkeiten" teilt, wobei dieser Rolle in Konflikt- und Spannungsfällen erhöhte Bedeutung zukommt (vgl. in diesem Sinne EGMR, 8. Juli 1999, Sürek/Türkei [Nr. 1], CE:ECHR:1999:0708JUD002668295, § 63).

Furthermore, the Court stresses that there is little scope under Article 10 § 2 of the Convention for restrictions on political speech or on the debate of questions of public interest (see, e.g., Feldek v. Slovakia, no. 29032/95, § 74, ECHR 2001-VIII; Sürek v. Turkey (no. 1) [GC], no. 26682/95, § 61, ECHR 1999-IV).However, even assuming that some demonstrators may have considered the flag as offensive, shocking, or even "fascist", for the Court, its mere display was not capable of disturbing public order or hampering the exercise of the demonstrators" right to assemble as it was neither intimidating, nor capable of inciting to violence by instilling a deep-seated and irrational hatred against identifiable persons (see Sürek v. Turkey (no. 1) [GC], no. 26682/95, § 62, ECHR 1999-IV).
