ROTARU v. ROMANIA

Par ailleurs, dans l'affaire Elli Poluhas Dödsbo c. Suède (no 61564/00, § 24, CEDH 2006-I), la Cour a considéré le refus d'autoriser le transfert de l'urne contenant les cendres du mari de la requérante comme une question tombant dans le champ d'application de l'article 8. Enfin, dans l'affaire Hadri-Vionnet c. IVANOV contre la LETTONIE
La Cour rappelle que, selon la jurisprudence constante de la Cour, les mots «prévue par la loi» imposent que la mesure incriminée ait une base en droit interne et visent aussi la qualité de la loi en cause: ainsi, celle-ci doit être accessible au justiciable et prévisible quant à son contenu et à ses effets juridiques (voir Amann c. Suisse [GC], no 27798/95, § 50, CEDH 2000-II).
