    The Court also reiterates that, where a complaint concerns allegations that a person's expulsion would expose him or her to a real risk of suffering treatment contrary to Article 3 of the Convention, the effectiveness of the remedy for the purposes of Article 13 requires imperatively - in view of the importance the Court attaches to Article 3 and given the irreversible nature of the harm that might occur if the risk of torture or ill-treatment alleged materialised - that that complaint be subject to independent and rigorous scrutiny by a national authority and that this remedy has automatic suspensive effect (see the Grand Chamber's statement of the law on Articles 13 and 3 in De Souza Ribeiro v. France [GC], no. 22689/07, § 82 with further references, ECHR 2012; Mohammed v. Austria, no. 2283/12, § 72 with further references, 6 June 2013; and A.D. and Others v.     Allerdings muss gezeigt werden, dass die Gefahr real ist und die Behörden des Empfangsstaats nicht in der Lage sind, der Bedrohung durch die Gewährung angemessenen Schutzes vorzubeugen (EGMR, Urteile vom 23.8.2016 - 59166/12 [J. K. and others v. Schweden] - HUDOC Rn. 80; vom 5.7.2016 - 29094/09 [A. M. v. The Netherlands] - HUDOC Rn. 79).

    An dieser Einschätzung hat der EGMR in jüngerer Zeit angesichts der ihm mittlerweile vorliegenden Informationen festgehalten (vgl. EGMR, Urteil vom 11.7.2017 - 46051/13 [S. M. A. v. The Netherlands] - HUDOC Rn. 53; Urteil vom 11.7.2017 - 41509/12 [Soleimankheel and others v. The Netherlands] - HUDOC Rn. 51; Urteil vom 11.7.2017 -77691/11 [G. R. S. v. The Netherlands] - HUDOC Rn. 39; Urteil vom 11.7.2017 - 72586/11 [E. K. v. The Netherlands] - HUDOC Rn. 67; Urteil vom 11.7.2017 - 63104/11 [E. P. and A. R. v. The Netherlands] - HUDOC Rn. 80; Urteil vom 16.5.2017 - 15993/09 [M. M. v. The Netherlands] - HUDOC Rn. 120; Urteil vom 5.7.2016 - 29094/09 [A. M. v. The Netherlands] - HUDOC Rn. 87; Urteil vom 12.1.2016 - 13442/08 [A. G. R. v. The Netherlands] - HUDOC Rn. 59) und entschieden, dass die allgemeine Lage in Afghanistan nicht so ernst sei, dass eine Abschiebung ohne Weiteres eine Verletzung von Art. 3 EMRK wäre.

    Der EGMR hat in seinem Urteil vom 5. Juli 2016 (- 29094/09 [A. M. v. The Netherlands] - HUDOC Rn. 86) ausgeführt, dass die allgemeine Situation in Afghanistan für diese Minderheit bei weitem nicht ideal sei.
