    Daneben spricht für den strafrechtlichen Charakter einer Norm, wenn sie nicht in erster Linie einen finanziellen Ausgleich für einen Schaden gewähren soll, sondern sowohl abschreckende (präventive) als auch bestrafende (repressive) Zwecke verfolgt, weil dies die üblichen Merkmale strafrechtlicher Sanktionen sind (EGMR-Urteile Öztürk/Deutschland in NJW 1985, 1273, Rz 53; Bendenoun/ Frankreich, Rz 47; J.B./Schweiz in NJW 2002, 499, Rz 48, und vom 23. Juli 2002  34619/97 --Janosevic/Schweden--, Rz 68).
