Romania, no. 32146/05, §§ 68-72, 16 February 2010; Centre for Legal Resources on behalf of Valentin Câmpeanu v. Romania [GC], no. 47848/08, § 130, ECHR 2014; and Powell v. the United Kingdom (dec.), no. 45305/99, ECHR 2000-V), maintained that in the area of health care the positive obligation arising for the Contracting States under Article 2 of the Convention with a view to preventing death caused by medical negligence was essentially of a procedural nature and involved a duty to put in place a regulatory structure requiring that hospitals, be they private or public, take appropriate steps to ensure that patients" lives were protected.In Powell v. the United Kingdom ((dec.), no. 45305/99, § 1, ECHR 2000-V), the Court held that although a State must make "adequate provision for securing high professional standards among health professionals... [the Court] cannot accept that matters such as error of judgment on the part of health professional or negligent co-ordination among health professionals in the treatment of a particular patient are sufficient of themselves to call a Contracting State to account..." Nevertheless, in a very recent case, namely Elena Cojocaru v. Romania (no. 74114/12, §§ 108, 111 and 125, 22 March 2016), the Court took a different stance.
The Erikson case-law was first confirmed by Powell v. the United Kingdom (dec.), no. 45305/99, ECHR 2000-V, and later on by Calvelli and Ciglio v. Italy [GC], no. 32967/96, § 48, ECHR 2002-I.

REYNOLDS v. THE UNITED KINGDOM
The County Court noted that the High Court in the Savage case had accepted that, where the allegations were of clinical negligence, the measure of the duty owed to both voluntary and involuntary patients was as outlined in Powell v. the United Kingdom ((dec.), no. 45305/99, ECHR 2000-V) and in R (Takoushis) v. Inner North London Coroner and Another ([2006] 1WLR 46) namely, that there had to be at least gross negligence of a kind sufficient to sustain a charge of manslaughter.It accepted that simple negligence in the care of a patient resulting in his or her death was not sufficient to amount to a breach of the State's obligation under Article 2 to protect life, although the position might be different where gross negligence or manslaughter had been alleged (relying, inter alia, on R (Goodson) v Bedfordshire and Luton Coroner [2004] EWHC 2931 (Admin), itself based on Powell v. the United Kingdom ((dec.), no. 45305/99, ECHR 2000-V).
The Trust contended before the High Court that the extent of the obligations of health authorities to protect a patient's life was to be found in Powell v. the United Kingdom ((dec.), no. 45305/99, ECHR 2000-V) namely, that the treatment alleged amounted either to gross negligence or to manslaughter.
The County Court concluded that it was unlikely that any appeal in Savage would render the Trust and Council liable under Article 2 because an allegation of ordinary negligent medical care was insufficient of itself to establish a breach of Article 2 of the Convention (Powell v. the United Kingdom, no. 45305/99, (dec.) 4 May 2000).

Présumant le bien-fondé de ces arguments comme une pure hypothèse de travail, la Cour relève que les problèmes dénoncés en l'espèce se présentent a priori comme étant le résultat conjugué, d'un côté, de négligences qui s'inscriraient dans le contexte, par exemple, d'une « erreur de jugement'de la part de professionnels de la santé ou d'une « mauvaise coordination'entre ceux-ci par rapport au traitement d'un patient en particulier (Powell c. Royaume-Uni (déc.), no 45305/99, 4 mai 2000, Calvelli et Ciglio c. Italie [GC], no 32967/96, § 49, CEDH 2002-I, Csiki c. Roumanie, no 11273/05, § 72, 5 juillet 2011, et Asiye Genç, précité, § 67 in fine) et, de l'autre, d'une situation qui dénoterait un dysfonctionnement du système de santé en Turquie (Asiye Genç, précité, §§ 72 et 73), fût-il propre à une région précise.Les actes et omissions des autorités internes dans le domaine des politiques de santé peuvent, dans certaines circonstances, engager leur responsabilité sous l'angle du volet matériel de l'article 2. Toutefois, dès lors qu'un État contractant a fait ce qu'il fallait pour assurer un haut niveau de compétence chez les professionnels de la santé et pour garantir la protection de la vie des patients, on ne peut admettre que des questions telles qu'une erreur de jugement de la part d'un professionnel de la santé ou une mauvaise coordination entre des professionnels de la santé dans le cadre du traitement d'un patient en particulier suffisent en elles-mêmes à obliger un État contractant à rendre des comptes en vertu de l'obligation positive de protéger le droit à la vie qui lui incombait aux termes de l'article 2 de la Convention (Powell c. Royaume-Uni (déc.), no 45305/99, CEDH 2000-V, Nitecki c. Pologne, no 65653/01 (déc.) 21 mars 2002, Glass c. Royaume-Uni, no 61827/00, CEDH 2004-II, Byrzykowski c.
