DALBAN v. ROMANIA
Roumanie [GC], no 28114/95, § 44, CEDH 1999-VI). - EGMR, 27.03.2001 - 25186/94
SUTHERLAND v. UNITED KINGDOM
Royaume-Uni [GC], no 25186/94, 27 mars 2001, non publiée). - EGMR, 22.04.1993 - 15070/89
MODINOS c. CHYPRE
Auszug aus EGMR, 09.01.2003 - 45330/99
21-22, § 50 ; Modinos c.

- EGMR, 24.02.1983 - 7525/76
DUDGEON c. ROYAUME-UNI (ARTICLE 50)
Royaume-Uni (satisfaction équitable), arrêt du 24 février 1983, série A no 59, pp. - EGMR, 18.07.1994 - 13580/88
KARLHEINZ SCHMIDT v. GERMANY
Allemagne, arrêt du 18 juillet 1994, série A no 291-B, pp. 32-33, § 24 ; Salgueiro da Silva Mouta c. Portugal, no 33290/96, § 29, CEDH 1999-IX, et Fretté c. France, no 36515/97, §§ 34 et 40, CEDH 2002-I). - EGMR, 26.10.1988 - 10581/83
NORRIS c. IRLANDE
Auszug aus EGMR, 09.01.2003 - 45330/99
7-8, § 14; Norris c. Irlande, arrêt du 26 octobre 1988, série A no 142, pp.
- EGMR, 01.07.2014 - 43835/11
Gesichtsschleier-Verbot rechtens
She observed that, in S.L. v. Austria (no. 45330/99, ECHR 2003-I), a seventeenyearold boy complaining of legislation prohibiting homosexual acts between adults and minors had been recognised by the Court as having victim status, despite the fact that only adult partners were liable to prosecution and no such prosecution was actually at issue. - EGMR, 24.07.2003 - 40016/98
KARNER c. AUTRICHE
- EGMR, 20.06.2017 - 67667/09
"Homosexuellen-Propaganda"-Gesetz in Russland: Diskriminierend - und …
They relied on the Court's caselaw to affirm that neither homosexuality nor homosexual behaviour contradicts the notion of public morals even in their broadest understanding (among other cases, they referred to Smith and Grady v. the United Kingdom, nos. 33985/96 and 33986/96, § 97, ECHR 1999-VI; S.L. v. Austria, no. 45330/99, § 44, ECHR 2003-I (extracts); and Alekseyev, cited above, § 84).
- EGMR, 12.11.2013 - 5786/08
Chypre, 22 avril 1993, § 24, série A no 259, A.D.T., précité, § 38 (actes homosexuels privés entre adultes consentants), S.L. c. Autriche, no 45330/99, § 44, CEDH 2003-I (actes homosexuels d'hommes adultes avec des adolescents consentants âgés de quatorze à dix-huit ans), Vajnai c. Hongrie, no 33629/06, § 54-56, CEDH 2008 (port d'une étoile rouge), Altug Taner Akçam c. - EGMR, 12.05.2014 - 25781/94
Türkei muss wegen Besetzung Zyperns Millionen zahlen
For instance, in S.L. v. Austria, no. 45330/99, § 52, ECHR 2003-I (extracts), the Court made an award for non-pecuniary damage, even though the impugned provision of the Austrian Criminal Code had already been repealed and the applicant had therefore "achieved in part the objective of his application". - EuGH, 15.01.2019 - C-258/17

EGMR, 9. Januar 2003, L. und V./Österreich, CE:ECHR:2003:0109JUD003939298, EGMR vom 9. Januar 2003, S.L./Österreich, CE:ECHR:2003:0109JUD004533099, sowie EGMR vom 21. KIYUTIN c. RUSSIE
The existence of a European consensus is an additional consideration relevant for determining whether the respondent State should be afforded a narrow or a wide margin of appreciation (see Dickson v. the United Kingdom [GC], no. 44362/04, § 81, ECHR 2007-XIII, and S.L. v. Austria, no. 45330/99, § 31, ECHR 2003-I (extracts)). - EGMR, 30.08.2011 - 37334/08
G. v. THE UNITED KINGDOM
It recalls that the concept of "private life" is a broad one and includes an individual's sexual life (see Dudgeon v. the United Kingdom, 22 October 1981, Series A no. 45; S.L. v. Austria, no. 45330/99, ECHR 2003-I), although the Court has observed that not every sexual activity carried out behind closed doors would necessarily fall within the scope of Article 8 (see Laskey, Jaggard and Brown, cited above, § 36).In these circumstances, the Court is prepared to accept that the sexual activities at issue fell within the meaning of "private life" (see, mutatis mutandis, S.L. v. Austria, no. 45330/99, ECHR 2003-I).

Austria, no. 45330/99, § 31, 9 January 2003). - Generalanwalt beim EuGH, 05.09.2018 - C-258/17

NORRIS c. IRLANDE
Auszug aus EGMR, 22.11.2001 - 45330/99
Nevertheless, the Court has held that Article 34 entitles individuals to contend that a law in itself violates their rights, without any individual measure of implementation, if they are directly affected by it or run a risk of being directly affected by it (see for instance the Klass and Others v. Germany judgment of 6 September 1976, Series A no. 28, p. 18, § 33 and the Norris v. Ireland judgment of 26 October 1988, Series A no. 142, p. 16, § 31). - EGMR, 22.04.1993 - 15070/89
MODINOS c. CHYPRE
Auszug aus EGMR, 22.11.2001 - 45330/99
It is true that in a number of comparable cases concerning the prohibition by criminal law of homosexual activities between consenting adults, the Court has held that the very existence of legislation directly affected the respective applicants" private life on the ground that they had no other choice than either to respect the law and to refrain from engaging in prohibited sexual acts to which they were disposed by reason of their sexual orientation, or to commit such acts and thereby become liable to prosecution (see the Dudgeon v. the United Kingdom judgment of 22 October 1981, Series A no. 45, p. 18, § 41, the Norris v. Ireland case, cited above, p. 16, § 32, and the Modinos v. Cyprus judgment of 22 April 1993, Series A no. 259, p. 11, § 24). - EGMR, 22.10.1981 - 7525/76
