L'article 3 de la Convention impose à l'Etat de s'assurer que tout prisonnier est détenu dans des conditions qui sont compatibles avec le respect de la dignité humaine, que les modalités d'exécution de la mesure ne soumettent pas l'intéressé à une détresse ou à une épreuve d'une intensité qui excède le niveau inévitable de souffrance inhérent à la détention et que, eu égard aux exigences pratiques de l'emprisonnement, la santé et le bien-être du prisonnier sont assurés de manière adéquate, notamment par l'administration des soins médicaux requis (voir, mutatis mutandis, les arrêts Aerts c. Belgique, 30 juillet 1998, Recueil 1998-V, p. 1966, §§ 64 et suiv., et Kudla c. Pologne [GC], no 30210/96, § 94, CEDH 2000-XI).Dans le contexte particulier des conditions de détention, la Cour a notamment déclaré que si l'article 3 ne peut être interprété comme établissant une obligation générale de libérer un détenu pour motifs de santé il impose à l'Etat de s'assurer que tout prisonnier est détenu dans des conditions qui sont compatibles avec le respect de la dignité humaine, et que, eu égard aux exigences pratiques de l'emprisonnement, la santé et le bien-être du prisonnier sont assurés de manière adéquate, notamment par l'administration des soins médicaux requis (voir, par exemple, l'arrêt Kudla c. Pologne [GC], no 30210/96, §§ 93-94, CEDH 2000-XI).

Je précise tout d'abord, parce que cela me paraît juste, que je n'ai vu dans cette affaire aucune intention des autorités judiciaires, pénitentiaires et médicales britanniques, d'humilier ou de maltraiter Judith McGlinchey, qui fut condamnée à quatre mois d'emprisonnement et, en conséquence, incarcérée à la prison de New Hall, Wakefield, à partir du 7 décembre 1998. Mais j'ajoute aussitôt que, aux yeux de la Cour, « l'absence d'un tel but ne saurait exclure de façon définitive le constat de violation de l'article 3'(voir les arrêts V. c. Royaume-Uni [GC], no 24888/94, § 71, CEDH 1999-IX, et Peers c. Grèce, no 28524/95, § 74, CEDH 2001-III).

The complaints intended to be made subsequently before the Court should have been made to the appropriate domestic body, at least in substance, and in compliance with the formal requirements laid down in domestic law and, further, that any procedural means that might prevent a breach of the Convention should have been used (see the Cardot v.
