    Eine willkürliche Verweigerung der Staatsangehörigkeit kann aber wegen der Auswirkung einer solchen Maßnahme auf das Privatleben einer Person in den Schutzbereich von Art. 8 EMRK fallen (vgl. EGMR, Genovese v. Malta, Urteil vom 11. Oktober 2011, Nr. 53124/09, § 32).

    Wenn ein Staat das Recht vorsieht, seine Staatsangehörigkeit zu erlangen, muss dieses Recht ohne Diskriminierung im Sinne des Art. 14 EMRK ausgestaltet sein, also auch ohne Diskriminierung gegenüber nichtehelichen Kindern (vgl. EGMR, Genovese v. Malta, Urteil vom 11. Oktober 2011, Nr. 53124/09, §§ 33 ff.).

    Die Mitgliedstaaten verfügen hier über einen gewissen Beurteilungsspielraum (vgl. EGMR, Inze v. Österreich, Urteil vom 28. Oktober 1987, Nr. 8695/79, § 41; Mazurek v. Frankreich, Urteil vom 1. Februar 2000, Nr. 34406/97, § 48; Genovese v. Malta, Urteil vom 11. Oktober 2011, Nr. 53124/09, § 43).

    Es müssen aber sehr gewichtige Gründe ("very weighty reasons") vorgebracht werden, damit eine unterschiedliche Behandlung von nichtehelichen Kindern als vereinbar mit der Europäischen Menschenrechtskonvention angesehen werden kann (vgl. EGMR, Inze v. Österreich, Urteil vom 28. Oktober 1987, Nr. 8695/79, § 41; Mazurek v. Frankreich, Urteil vom 1. Februar 2000, Nr. 34406/97, § 49; Camp and Bourimi v. Niederlande, Urteil vom 3. Oktober 2000, Nr. 28369/95, § 38; Genovese v. Malta, Urteil vom 11. Oktober 2011, Nr. 53124/09, § 44).

    Die Ungleichbehandlung nichtehelicher Kinder stellt eine Diskriminierung im Sinne des Art. 14 EMRK dar, wenn es für sie keine objektive und vernünftige Rechtfertigung gibt, sie also entweder kein legitimes Ziel verfolgt oder aber unverhältnismäßig ist (vgl. EGMR, Inze v. Österreich, Urteil vom 28. Oktober 1987, Nr. 8695/79, § 41; Mazurek v. Frankreich, Urteil vom 1. Februar 2000, Nr. 34406/97, § 48; Brauer v. Deutschland, Urteil vom 28. Mai 2009, Nr. 3545/04, § 39; Genovese v. Malta, Urteil vom 11. Oktober 2011, Nr. 53124/09, § 43).

    Der Europäische Gerichtshof für Menschenrechte verlangt "sehr gewichtige Gründe", damit eine ungleiche Behandlung von nichtehelichen Kindern als vereinbar mit der Europäischen Menschenrechtskonvention angesehen werden kann (vgl. EGMR, Genovese v. Malta, Urteil vom 11. Oktober 2011, Nr. 53124/09, § 44: "[...] very weighty reasons would have to be advanced before what appears to be an arbitrary difference in treatment on the ground of birth out of wedlock could be regarded as compatible with the Convention.").

    Deshalb kann die einseitige Zuordnung des nichtehelichen Kindes zu seiner Mutter keinen sehr gewichtigen Grund darstellen, um den Nichterwerb der Staatsangehörigkeit des nichtehelichen Vaters und die damit verbundene Benachteiligung des nichtehelichen Kindes zu rechtfertigen (vgl. EGMR, Genovese v. Malta, Urteil vom 11. Oktober 2011, Nr. 53124/09, § 46).

    It has also established that Article 8 embraces multiple aspects of the person's physical and social identity, like the recognition of an individual's legal civil status (registration of a marriage in Dadouch v. Malta, no. 38816/07, § 48, ECHR 2010 (extracts), and refusal of nationality in Genovese v. Malta, no. 53124/09, §§ 30 and 33, 11 October 2011).
