SLIVENKO v. LATVIA
Auszug aus EGMR, 22.06.2006 - 59643/00
Nor is there anything to show that she could legally claim Latvian citizenship under that country's laws, or that it was arbitrarily denied her (see, mutatis mutandis, Slivenko v. Latvia (dec.) [GC], no. 48321/99, §§ 77-78, ECHR 2002-II).As to the existence of "family life" within the meaning of Article 8 § 1, the Court observes that the deportation order issued in 1995 in respect of the applicant also related to her daughter; as both were enjoined to leave the country, the measure could not have had the effect of breaking up their life together (see Slivenko v. Latvia [GC], no. 48321/99, § 97, ECHR 2003-X).
It is true that this very restrictive interpretation of the notion of family life is in line - in the specific sphere of the entry, residence and expulsion of non-nationals - with the case-law established in Slivenko (see Slivenko v. Latvia [GC], no. 48321/99, § 97, ECHR 2003-X).

SCOZZARI ET GIUNTA c. ITALIE
Auszug aus EGMR, 22.06.2006 - 59643/00
The Court went on to conclude that ""respect" for a family life so understood implies an obligation for the State to act in a manner calculated to allow these ties to develop normally" (see Marckx v. Belgium, judgment of 13 June 1979, Series A no. 31, p. 21, § 45; see also Scozzari and Giunta v. Italy [GC], nos. 39221/98 and 41963/98, § 221, ECHR 2000-VIII). - EGMR, 01.06.2004 - 45582/99
L. v. THE NETHERLANDS
Auszug aus EGMR, 22.06.2006 - 59643/00
By way of example I would cite the L. judgment of 1 June 2004, in which the Court accepted that family life could also exist between a child and a parent who had never lived together, if other factors demonstrated that the relationship had sufficient constancy to create de facto family ties (see L. v. the Netherlands, no. 45582/99, § 36, ECHR 2004-IV)[1].
- EGMR, 13.06.1979 - 6833/74
MARCKX v. BELGIUM
- EGMR, 28.09.1999 - 28114/95
DALBAN v. ROMANIA
Auszug aus EGMR, 22.06.2006 - 59643/00
Similarly, in relation to Article 34, the Court has always held that, as a general rule, a decision or measure favourable to the applicant is not sufficient to deprive him of his status as a "victim" unless the national authorities have acknowledged, either expressly or in substance, and then afforded redress for, the alleged breach of the Convention (see, among many other authorities, Amuur v. France, judgment of 25 June 1996, Reports of Judgments and Decisions 1996-III, p. 846, § 36; Dalban v. Romania [GC], no. 28114/95, § 44, ECHR 1999-VI; Labita v. Italy [GC], no. 26772/95, § 142, ECHR 2000-IV; and Guisset v. France, no. 33933/96, § 66, ECHR 2000-IX). - EGMR, 28.10.1999 - 40772/98
PANCENKO v. LATVIA
Auszug aus EGMR, 22.06.2006 - 59643/00
However, the present application concerns the removal of a foreign national and her illegal residence within the national territory; in cases of this type, where the applicant's stay was regularised during the course of the Court's examination of the application, the Court has generally considered whether it should continue its examination under Article 34 of the Convention by reference precisely to the notion of "victim" (see, for example, Maaouia v. France (dec.), no. 39652/98, ECHR 1999-II; Pancenko v. Latvia (dec.), no. 40772/98, 28 October 1999; Mikheyeva v. Latvia (dec.), no. 50029/99, 12 September 2002; Aristimuño Mendizabal v. France, (dec.), no. 51431/99, 21 June 2005; and Yildiz v. Germany (dec.), no. 40932/02, 13 October 2005). - EGMR, 30.11.1999 - 34374/97
BAGHLI v. FRANCE
Auszug aus EGMR, 22.06.2006 - 59643/00
The Court reiterates that the Convention does not guarantee as such the right of an alien to enter or to reside in a particular country and that Contracting States have the right, as a matter of well-established international law and subject to their treaty obligations including the Convention, to control the entry, residence and expulsion of aliens (see, among many other authorities, Baghli v. France, no. 34374/97, § 45, ECHR 1999-VIII, and Boultif v. Switzerland, no. 54273/00, § 39, ECHR 2001-IX). - EGMR, 25.01.2000 - 31679/96
IGNACCOLO-ZENIDE v. ROMANIA
Auszug aus EGMR, 22.06.2006 - 59643/00
Furthermore, while the chief object of Article 8 is to protect the individual against arbitrary interference by the public authorities, it does not merely compel the State to abstain from such interference: in addition to this negative undertaking, there may be positive obligations inherent in effective respect for private or family life (see, for example, Gül v. Switzerland, judgment of 19 February 1996, Reports 1996-I, pp. 174-175, § 38; Ignaccolo-Zenide v. Romania, no. 31679/96, § 94, ECHR 2000-I; and Mehemi (no. 2), cited above, § 45). - EGMR, 06.04.2000 - 26772/95
LABITA c. ITALIE
- EGMR, 26.09.2000 - 33933/96

FRESSOZ ET ROIRE c. FRANCE
France [GC], no 29183/95, § 37, CEDH 1999-I, et Civet c. Roumanie [GC], no 28114/95, § 44, CEDH 1999-VI). - EGMR, 28.09.1999 - 29340/95

Suisse, arrêt du 19 février 1996, Recueil 1996-I, pp. 174-175, § 38 ; Ignaccolo-Zenide c. Roumanie, no 31679/96, § 94, CEDH 2000-I, et Mehemi c. VIJAYANATHAN AND PUSPARAJAH v. FRANCE
- EGMR, 05.12.2023 - 71200/17
BRAZAUSKIENE v. LITHUANIA
In the light of the above, and in view of the particular circumstances of the instant case, the Court considers that the matter regarding the applicant's complaint of not having been granted and paid the State annuity as the widow of President Algirdas Mykolas Brazauskas has been effectively resolved and that this part of the application should be struck out of the Court's list of cases in accordance with Article 37 § 1 (b) of the Convention (see, mutatis mutandis, Kaftailova v. Latvia (striking out) [GC], no. 59643/00, § 48, 7 December 2007). - EGMR, 27.11.2018 - 45434/12
J.B. AND OTHERS v. HUNGARY
In this connection, the Court also emphasises that, depending on the events that have occurred subsequent to the lodging of an application, it may strike a case out of its list on one or more of the grounds set out in Article 37 of the Convention, notwithstanding the fact that the applicant can still claim "victim" status (see Pisano v. Italy (striking out) [GC], no. 36732/97, § 39, 24 October 2002), or even irrespective of the question whether the applicant can still claim such status (see Sisojeva and Others v. Latvia (striking out) [GC], no. 60654/00, § 96, ECHR 2007-I; Association SOS Attentats and de Boëry v. France (dec.) [GC], no. 76642/01, § 41, ECHR 2006-XIV; Kaftailova v. Latvia (striking out) [GC], no. 59643/00, § 47, 7 December 2007; and El Majjaoui and Stichting Touba Moskee v. the Netherlands (striking out) [GC], no. 25525/03, § 29, 20 December 2007). - EGMR, 06.10.2016 - 3342/11
RICHMOND YAW ET AUTRES c. ITALIE
Allemagne, 15 juillet 1982, § 66, série A, no 51, Amuur c. France, 25 juin 1996, § 36, Recueil des arrêts et décisions 1996-III, Guisset c. France, no 33933/96, § 66, CEDH 2000-XI, et Kaftailova c. Lettonie (déc.), no 59643/00, 21 octobre 2004).
- EGMR, 26.04.2018 - 63311/14
HOTI v. CROATIA
In such cases, the Court has accepted that the cases of applicants who, following the break-up of a predecessor State, were given unequivocal assurances by the relevant authorities that they would be granted permanent residence, which then required them to diligently comply with further arrangements related to the granting of that status, should be struck out from the Court's list of cases under Article 37 § 1 (b) of the Convention (see Shevanova v. Latvia (striking out) [GC], no. 58822/00, § 46, 7 December 2007; Kaftailova v. Latvia (striking out) [GC], no. 59643/00, § 49, 7 December 2007; and Sisojeva and Others, cited above, §§ 98-99; see also, concerning victim status, Kuric and Others v. Slovenia [GC], no. 26828/06, § 266, ECHR 2012 (extracts); and further compare Khan v. Germany [GC], no. 38030/12, § 33, 21 September 2016, concerning the regularisation of the status of failed asylum seekers in connection with a risk of expulsion). - EGMR, 10.10.2006 - 25389/05
GEBREMEDHIN
Allemagne du 15 juillet 1982, série A, no 51, § 66, Amuur c. Lettonie, no 59643/00, du 21 octobre 2004). - EGMR, 25.01.2022 - 52350/18
MARO v. RUSSIA
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court considers that the matter has been resolved, within the meaning of Article 37 § 1 (b) of the Convention (see Kaftailova v. Latvia (striking out) [GC], no. 59643/00, § 48, 7 December 2007). - EGMR, 24.03.2016 - 28026/05
SHARMA v. LATVIA
With reference to several previous cases against Latvia (Sisojeva and Others v. Latvia, (striking out) [GC], no. 60654/00, ECHR 2007-I; Kaftailova v. Latvia (striking out) [GC], no. 59643/00, 7 December 2007; and Shevanova v. Latvia (striking out) [GC], no. 58822/00, 7 December 2007), the Government invited the Court to strike the application out of its list of cases as "the matter has been resolved" as far as the complaint under Article 8 of the Convention was concerned. - EGMR, 06.05.2008 - 49662/07
GHADERYPOOR v. TURKEY
However, neither the invoice nor the applicant's claims for costs and expenses submitted to the Court specify the exact nature of the legal services provided by Mr Efe or provide information on how many hours were spent by him in litigating the application (see, mutatis mutandis, Kaftailova v. Latvia (striking out) [GC], no. 59643/00, §§ 60-61, 7 December 2007). - EGMR, 18.10.2022 - 31149/12
DABETIC v. ITALY
The fact that the applicants were no longer at risk of deportation has also been taken into account by the Court (see Kuric and Others, cited above, § 266, and the case-law cited therein; Sisojeva and Others v. Latvia (striking out) [GC], no. 60654/00, §§ 102-04, ECHR 2007-I; Shevanova v. Latvia (striking out) [GC], no. 58822/00, §§ 48-50, 7 December 2007; and Kaftailova v. Latvia (striking out) [GC], no. 59643/00, § 54, 7 December 2007).
