  • EGMR, 04.12.2003 - 39272/98

    M.C. c. BULGARIE

    Auszug aus EGMR, 19.07.2018 - 60561/14
In these cases like in cases concerning acts such as rape and sexual abuse fundamental values, human dignity and essential aspects of private life are at stake (see X and Y v. the Netherlands, 26 March 1985, § 27, Series A no 91 and M.C. v. Bulgaria, no. 39272/98, § 150, ECHR 2003-XII).

It is well established that States have a positive obligation inherent in both Articles 3 and 4 of the Convention to enact criminal-law provisions effectively punishing serious acts prohibited under those provisions, even where they are not committed by State agents but by private individuals, and to apply them in practice through effective investigation and prosecution (see M.C. v. Bulgaria, no. 39272/98, § 153, ECHR 2003-XII, and L.E. v. Greece, no. 71545/12, §§ 65 and 68, 21 January 2016).

  • EGMR, 02.11.2010 - 38281/08

    MATASARU AND SAVITCHI v. MOLDOVA

    Auszug aus EGMR, 19.07.2018 - 60561/14
Consideration has been given in the Court's judgments to matters such as the opening of investigations, delays in identifying witnesses or taking statements (see Matasaru and Savitchi v. Moldova, no. 38281/08, §§ 88 and 93, 2 November 2010), the length of time taken for the initial investigation (see Indelicato v. Italy, no. 31143/96, § 37, 18 October 2001), and unjustified protraction of the criminal proceedings resulting in the expiry of the statute of limitations (see Angelova and Iliev v. Bulgaria, no. 55523/00, §§ 101-03, 26 July 2007).

    LABITA c. ITALIE

    Auszug aus EGMR, 19.07.2018 - 60561/14
The promptness of the authorities" reaction to the complaints is an important factor (see Labita v. Italy [GC], no. 26772/95, §§ 133 et seq., ECHR 2000-IV).
  • EGMR, 17.10.2006 - 52067/99

    OKKALI c. TURQUIE

    Auszug aus EGMR, 19.07.2018 - 60561/14
The important point for the Court to review is whether and to what extent the prosecuting authorities in taking their actions and the courts in reaching their conclusion may be deemed to have submitted the case to the careful scrutiny required by Article 4 of the Convention, so that the deterrent effect of the criminal-law system in place and the significance of the role it is required to play in preventing violations of the rights protected under Article 4 of the Convention are not undermined (see, mutatis mutandis, Okkali v. Turkey, no. 52067/99, § 66, ECHR 2006-XII (extracts)).

Ausreichende Untersuchung von Anschuldigungen von Menschenhandel

    Auszug aus EGMR, 19.07.2018 - 60561/14
The identified elements of trafficking - the treatment of human beings as commodities, close surveillance, the circumscription of movement, the use of violence and threats, poor living and working conditions, and little or no payment - cut across these three categories (see Rantsev, cited above, §§ 279-82; see also J. and Others v. Austria, no. 58216/12, § 104, ECHR 2017 (extracts).

    INDELICATO c. ITALIE

COBZARU v. ROMANIA

    Auszug aus EGMR, 19.07.2018 - 60561/14
Moreover, notwithstanding its subsidiary role in assessing evidence, the Court has held that where allegations are made under Article 3 of the Convention the Court must apply a particularly thorough scrutiny, even if certain domestic proceedings and investigations have already taken place (see Cobzaru v. Romania, no. 48254/99, § 65, 26 July 2007).

  • EGMR, 06.07.2005 - 43579/98
    Auszug aus EGMR, 25.06.2020 - 60561/14
In assessing whether there has been a violation of Article 4, the relevant legal or regulatory framework in place must be taken into account (see, mutatis mutandis, Nachova and Others v. Bulgaria [GC], nos. 43577/98 and 43579/98, § 93, ECHR 2005-VII).

In the context of Articles 2 and 3, the Court has held that any deficiency in the investigation which undermines its capability of establishing the circumstances of the case or the person responsible is liable to fall foul of the required measure of effectiveness (see, in the context of Article 2, Nachova and Others v. Bulgaria [GC], nos. 43577/98 and 43579/98, § 113, ECHR 2005-VII, and Armani da Silva, v. the United Kingdom [GC], no. 5878/08, § 233 in fine, 30 March 2016; see also, in the context of Article 3, Denis Vasilyev, cited above, § 100, and Milena Felicia Dumitrescu, cited above, § 52).

    See Nachova and Others v Bulgaria ï?GCï, nos 43577/98 and 43579/98, § 161, ECHR 2005-VII.

  • EGMR, 30.03.2016 - 5878/08

    ARMANI DA SILVA c. ROYAUME-UNI

    Auszug aus EGMR, 25.06.2020 - 60561/14

Furthermore, although the domestic courts have considerable discretion in choosing the appropriate sanction for serious human rights violations, the Court retains a certain measure of supervision and has the possibility to intervene in cases where there is a clear disproportion between the offence committed and the sanction imposed (see Armani Da Silva v. the United Kingdom, no. 5878/08, § 285, 30 March 2016; see also Kasap and Others v. Turkey, no. 8656/10, §§ 60-62, 14 January 2014; Darraj v. France, no. 34588/07, § 49, 4 November 2010; Kopylov v. Russia, no. 3933/04, § 141, 29 July 2010; and Chowdury and Others, cited above, §§ 124-27).

  • EGMR, 28.05.2015 - 41107/10

    Y. v. SLOVENIA

    Auszug aus EGMR, 25.06.2020 - 60561/14
As to the level of scrutiny to be applied by the Court in this regard, it is important to stress that, although the Court has recognised that it must be cautious in taking on the role of a first-instance tribunal of fact where this is not rendered unavoidable by the circumstances of a particular case, it has to apply a "particularly thorough scrutiny" even if certain domestic proceedings and investigations have already taken place (see Bouyid, cited above, § 85, with further references; see also Aktas v. Turkey, no. 24351/94, § 271, ECHR 2003-V (extracts), and Y. v. Slovenia, no. 41107/10, § 96, ECHR 2015 (extracts)).

The Court is increasingly recognising victims" rights in criminal proceedings as human rights, and as it has demonstrated in this case, it is ready to acknowledge the need to protect them not only under Article 8, as part of the effective respect of private life and personal integrity (see Y. v. Slovenia, no. 41107/10, §§ 100-01 and §§ 103-04, ECHR 2015 (extracts)), but also as part of a procedural obligation for the State (see paragraph 344 of the judgment), provided that a fair balance has been struck between the competing interests of the defence and the rights of the victims (see Y. v. Slovenia, cited above, § 103).

  • EGMR, 16.09.2014 - 29750/09

    HASSAN c. ROYAUME-UNI

    Auszug aus EGMR, 25.06.2020 - 60561/14
This corresponds in essence to the Court's approach in other cases concerning, in particular, Article 3 of the Convention (see, for instance, Hassan v. the United Kingdom [GC], no. 29750/09, § 62, ECHR 2014; Bouyid, cited above, § 124; and Beganovic v. Croatia, no. 46423/06, § 68, 25 June 2009).

Consequently, the prima facie evidence to which the Court refers in this judgment (see paragraphs 324, 325, 331 and 332) corresponds to the notion of "sufficiently clear indications" to which the Court commonly refers under Article 3 in this regard (see, for example, Hassan v. the United Kingdom ï?GCï, no. 29750/09, § 62, ECHR 2014; M.S. v. Croatia (no. 2), no. 75450/12, § 76, 19 February 2015; Members (97) of the Gldani Congregation of Jehovah's Witnesses, cited above, § 97; and Bati and Others v. Turkey, nos.

  • EGMR, 15.03.2016 - 61495/11

    M.G.C. v. ROMANIA

    Auszug aus EGMR, 25.06.2020 - 60561/14
The above approach under Articles 2 and 3 in essence corresponds to the Court's approach in Siliadin (cited above, § 130), where it stressed that the possible defects in the relevant proceedings and the decision-making process must amount to significant flaws in order to raise an issue under Article 4 (see also, for instance, M.G.C. v. Romania, no. 61495/11, §§ 60-61, 15 March 2016, concerning sexual abuse under Articles 3 and 8 of the Convention).
  • EGMR, 30.03.2017 - 21884/15

    CHOWDURY ET AUTRES c. GRÈCE

    Auszug aus EGMR, 25.06.2020 - 60561/14
Sixthly, it is important to note that when an investigation leads to the initiation of proceedings before the domestic courts, the proceedings as a whole, including the trial phase, must meet the above criteria for an effective investigation (see Öneryildiz v. Turkey ï?GCï, no. 48939/99, §§ 95-96, ECHR 2004-XII; Ali and Ayse Duran v. Turkey, no. 42942/02, § 61, 8 April 2008; and Chowdury and Others v. Greece, 21884/15, §§ 123 and §§ 127-28, 30 March 2017).
  • EGMR, 04.05.2001 - 28883/95

    McKERR c. ROYAUME-UNI

    Auszug aus EGMR, 25.06.2020 - 60561/14
Compliance with a State's procedural obligation under the Convention requires the domestic legal system to demonstrate its capacity and willingness to apply the criminal law against those who have unlawfully taken the life of another, violated his or her physical integrity (see Agdas v. Turkey, no. 34592, § 102, 27 July 2004, and McKerr v. the United Kingdom, no. 28883/95, § 134, ECHR 2001-III) or grossly violated another guaranteed right of a person, for instance by exposing the person to forced labour (see Chowdury and Others, cited above).
  • EGMR, 14.03.2002 - 46477/99

PAUL ET AUDREY EDWARDS c. ROYAUME-UNI

    Auszug aus EGMR, 25.06.2020 - 60561/14
The requirement to investigate does not depend on a complaint from the victim or next-of-kin: once the matter has come to the attention of the authorities they must act of their own motion (see, mutatis mutandis, Paul and Audrey Edwards v. the United Kingdom, no. 46477/99, § 69, ECHR 2002-II).

    GOLDER c. ROYAUME-UNI

    Auszug aus EGMR, 25.06.2020 - 60561/14
Under that Convention, the Court is required to ascertain the ordinary meaning to be given to the words in their context and in the light of the object and purpose of the provision from which they are drawn (see Golder v. the United Kingdom, 21 February 1975, § 29, Series A no. 18; Loizidou, cited above, § 43; and Article 31 § 1 of the Vienna Convention).

    MAKARATZIS c. GRECE

    Auszug aus EGMR, 25.06.2020 - 60561/14
The Court is of the view that the above multiple shortcomings in the conduct of the case by the prosecuting authorities fundamentally undermined the domestic authorities" - including the relevant courts" - ability to determine the true nature of the applicant's and T.M."s relationship and whether the applicant had been exploited by him as she alleged (compare Makaratzis v.
