    The Court observes that it has held that in certain circumstances, the State's positive obligations under Article 8 of the Convention are not adequately fulfilled unless it secures respect for private life in the relations between individuals by setting up a legislative framework taking into consideration the various interests to be protected in a particular context (see X and Y v. the Netherlands, cited above, §§ 23, 24 and 27, and M.C. v. Bulgaria, no. 39272/98, § 150, ECHR 2003-XII, both concerning sexual assaults of minors; see also K.U. v. Finland, no. 2872/02, §§ 43 and 49, ECHR 2008, concerning an advertisement of a sexual nature placed on an internet dating site in the name of a minor; Söderman, cited above, § 85, concerning the effectiveness of remedies in respect of an alleged violation of personal integrity committed by a close relative; and Codarcea v. Romania, no. 31675/04, §§ 102-04, 2 June 2009, concerning medical negligence).

    The legal framework could also consist of civil-law remedies capable of affording sufficient protection (see, mutatis mutandis, X and Y v. the Netherlands, 26 March 1985, §§ 24 and 27, Series A no. 91, and K.U. v. Finland, no. 2872/02, § 47, ECHR 2008).

    (5) Bei der Interessenabwägung stellt eine "berechtigte Privatheitserwartung" des Betroffenen einen beachtlichen Faktor dar (EGMR 9. Januar 2018 - 1874/13, 8567/13 - [López Ribalda ua./Spanien] Rn. 57; [Große Kammer] 5. September 2017 - 61496/08 - [Barbule scu/Rumänien] Rn. 119 - 122; vgl. auch Erwägungsgrund 47 zur Verordnung [EU] 2016/679 des Europäischen Parlaments und des Rates vom 27. April 2016 zum Schutz natürlicher Personen bei der Verarbeitung personenbezogener Daten, zum freien Datenverkehr und zur Aufhebung der Richtlinie 95/46/EG [Datenschutz-Grundverordnung; DS-GVO]: "vernünftige Erwartungen") , der selbst dann zugunsten des Nichtverarbeitungsinteresses des Arbeitnehmers den Ausschlag geben kann, wenn das Verarbeitungsinteresse des Arbeitgebers hoch ist.

    Das gilt jedenfalls dann, wenn die Maßnahme offen erfolgt und der Arbeitnehmer im Vorfeld darauf hingewiesen worden ist, welche legitimen Gründe eine Einsichtnahme in - vermeintlich - dienstliche Ordner und Dateien erfordern können (vgl. EGMR [Große Kammer] 5. September 2017 - 61496/08 - [Barbule scu/Rumänien] Rn. 119 - 122) , und dass er Ordner und Dateien durch eine Kennzeichnung als "privat" von einer Einsichtnahme ohne "qualifizierten" Anlass ausschließen kann (vgl. EGMR 22. Februar 2018 - 588/13 - [Libert/Frankreich]) .

    Ist der Sendevorgang abgeschlossen, kommt ein Verwertungsverbot von E-Mails nach

    Der EGMR hat zu der Überwachung des elektronischen Schriftverkehrs am Arbeitsplatz betont, dass Anlass und Ausmaß einer Kontrolle bzw. Überwachung möglichst im Vorhinein durch den Arbeitgeber transparent gemacht werden muss (vgl. EGMR 5. September 2017 - 61496/08 - [Barbulsecu/Rumänien] Rn. 121, 130, NZA 2017, 1443; hierzu auch Niemann JbArbR Bd. 55 S. 41, 66; Conrad/Hausen in Auersdorff/Conrad Handbuch IT- und Datenschutzrecht 2. Aufl. § 37 Rn. 208) .

    Ferner ist zu bewerten, ob ein Kontrollsystem hätte eingerichtet werden können, welches weniger stark in die Rechte der Betroffenen eingegriffen hätte ( vgl. EGMR 5. September 2017 - 61496/08 - [Barbulsecu/Rumänien] Rn. 121, NZA 2017, 1443).

    Gleichwohl hat der EGMR entschieden, dass dies nicht dem Schutz des Persönlichkeitsrechts entgegenstünde, denn solche Anweisungen könnten das private soziale Leben am Arbeitsplatz nicht auf Null reduzieren (vgl. EGMR 5. September 2017 - 61496/08 - [Barbulsecu/Rumänien] Rn. 80, NZA 2017, 1443).

    Auch handelt es sich nicht deshalb um eine weniger schutzwürdige "offizielle" Korrespondenz, weil sie von dem Rechner des Arbeitgebers am Arbeitsplatz ausging (vgl. EGMR 5. September 2017 - 61496/08 - [Barbulsecu/Rumänien] Rn. 73, NZA 2017, 1443).

    Nichts anderes gilt, wenn die vertrauliche Kommunikation nicht in einem persönlichen Gespräch stattfand, sondern per E-Mail (vgl. EGMR 5. September 2017 - 61496/08 - [Barbulsecu/Rumänien] Rn. 74, NZA 2017, 1443; Kock/Dittrich DB 2013, 934, 937; Fuhlrott/Oltmanns NZA 2016, 785, 787; Bauer/Günther NZA 2013, 67, 68, letztere jeweils im Schwerpunkt zu Äußerungen über Facebook) .

    Der Eingriff in den Schutzbereich von Art. 2 Abs. 1 i.V.m. Art. 1 Abs. 1 GG entfällt nicht dadurch, dass lediglich Verhaltensweisen am Arbeitsplatz erfasst werden (vgl. BAG 27. Juli 2017 - 2 AZR 681/16 - Rn. 25, NZA 2017, 1327; insbesondere zum elektronischen Schriftverkehr EGMR 5. September 2017 - 61496/08 - [Barbulsecu/Rumänien] Rn. 74, NZA 2017, 1443) .

    50 (2) Soweit die Klägerin auf die Entscheidung des Europäischen Gerichtshofs für Menschenrechte in der Rechtssache B. ./. Rumänien (EGMR 05.09.2017 - 61496/08 - NZA 2017, 1443) verweist, verkennt sie, dass wegen des Beschäftigtendatenschutzes eine Mitarbeiterkontrolle nicht vollkommen ausgeschlossen ist.

    59. While it is true that it had not been claimed that the applicant had caused actual damage to his employer (compare and contrast Pay v. United Kingdom, (dec.), no. 32792/05, 16 September 2008 where the applicant was involved outside work in activities that were not compatible with his professional duties, and Köpke (cited above), where the applicant had caused material losses to her employer), the Court finds that it is not unreasonable for an employer to want to verify that the employees are completing their professional tasks during working hours.

    The Court has already stated that privacy rights may not be asserted in the context of conduct away from the workplace, relied upon by an employer as grounds for dismissal (Pay v. the United Kingdom (dec.), no. 32792/05, 16 September 2008).
