  • EGMR, 01.12.2011 - 8080/08

Juli 1980, Decisions and Reports (DR) 21, S. 148-149; und, sinngemäß, Ezelin, a.a.O., Rdnr. 41).
  • EGMR, 12.05.2015 - 73235/12

    IDENTOBA AND OTHERS v. GEORGIA

As to the first applicant's complaints under Articles 10 and 11 of the Convention, taken separately or in conjunction with Article 14, the Court observes that legal entities can, in principle, be affected in the exercise of their own right to freedom of expression and to freedom of peaceful assembly (see, for instance, Ukrainian Media Group v. Ukraine, no. 72713/01, §§ 38-70, 29 March 2005, and Christians against Racism and Fascism v. the United Kingdom, no. 8440/78, Commission decision of 16 July 1980, Decisions and Reports 21, p. 138).

    LASHMANKIN AND OTHERS v. RUSSIA

Only if the disadvantage of such demonstrations being caught by the ban is clearly outweighed by the security considerations justifying the issue of the ban, and if there is no possibility of avoiding such undesirable side effects of the ban by a narrow circumscription of its scope in terms of territorial application and duration, can the ban be regarded as being necessary within the meaning of Article 11 § 2 of the Convention (see Christians against Racism and Fascism v. the United Kingdom, no. 8440/78, Commission decision of 16 July 1980).
  • EGMR, 23.10.2008 - 10877/04

    SERGEY KUZNETSOV v. RUSSIA

The Court reiterates at the outset that the right to freedom of assembly covers both private meetings and meetings on public thoroughfares, as well as static meetings and public processions; this right can be exercised both by individual participants and by those organising the assembly (see Djavit An v. Turkey, no. 20652/92, § 56, ECHR 2003-III, and Christians against Racism and Fascism v. the United Kingdom, no. 8440/78, Commission decision of 16 July 1980, Decisions and Reports 21, p. 138, at p. 148).
  • EKMR, 06.03.1989 - 13079/87

    G. v. THE FEDERAL REPUBLIC OF GERMANY

The notion of "peaceful assembly" does not, however, cover a demonstration where the organisers and participants have violent intentions which result in public disorder (cf. No. 8440/78, Dec. 16.7.80, D.R. 21 p. 138).

    GÜN ET AUTRES c. TURQUIE

Against Racism and Fascism c. Royaume-Uni, no 8440/78, décision de la Commission du 16 juillet 1980, Décisions et rapports (DR) 21, p. 162).
  • EGMR, 01.02.2011 - 2344/02

    DRITSAS ET AUTRES c. ITALIE

Royaume-Uni, no 8440/78, 16 juillet 1980, DR 21, p. 138).
  • EGMR, 30.04.2019 - 48310/16

    KABLIS v.
