    Sie nahm insbesondere Bezug auf die Rechtssprechung des Gerichtshofs in der Rechtssache Eskelinen Vilho Eskelinen u.a. ./. Finnland [GK], Nr. 63235/00, Randnr. 62, ECHR 2007, aus der sich schließen lasse, dass Artikel 6 der Konvention nur auf gewöhnliche arbeitsrechtliche Streitigkeiten über Gehalt, Zulagen oder ähnliche Ansprüche anwendbar sei.

    Es ist Sache der beschwerdegegnerischen Regierung, darzulegen, dass erstens der Beschwerdeführer als Beamter nach innerstaatlichem Recht kein Recht auf Zugang zu einem Gericht hat, und zweitens, dass der Ausschluss des Beamten von den Rechten aus Artikel 6 gerechtfertigt ist (siehe Vilho Eskelinen u.a. ./. Finnland [GK], Individualbeschwerde Nr. 63235/00, Nr. 62, ECHR 2007-...).

    In Bezug auf einen ähnlichen Rechtsbehelf im baden-württembergischen Disziplinarrecht hat der Verwaltungsgerichtshof Mannheim entschieden, dass eine unangemessene Länge des Verfahrens nicht zur Einstellung des Disziplinarverfahrens gegen den Beamten führen könne, weil das Disziplinarrecht einen wirksamen Rechtsbehelf zur Verfahrensbeschleunigung vorsehe (siehe Verwaltungsgerichtshof Mannheim, Urteil vom 18.6.2003, DL 17 S 5/03).

    McFARLANE v. IRELAND

    The Court recalls its constant case law to the effect that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and of the relevant authorities and what was at stake for the applicant (for example, Sürmeli v. Germany [GC], no. 75529/01, § 128, ECHR 2006-VII).

    "Remedies available to a litigant at domestic level for raising a complaint about length of proceedings are "effective"... if they prevent the alleged violation or its continuation, or provide adequate redress for any violation that has already occurred (Scordino v. Italy (no. 1) [GC], no. 36813/97, ECHR 2006-V; Sürmeli v. Germany [GC], no. 75529/01, § 65, ECHR 2006-VII; and Kudla v. Poland, cited above, §§ 157 to 159).
