      68.  An interference with the exercise of an Article 8 right will not be compatible with Article 8 § 2 unless it is "in accordance with the law", has an aim or aims that is or are legitimate under that paragraph and is "necessary in a democratic society" for the aforesaid aim or aims (see the Dudgeon v. the United Kingdom judgment of 22 October 1981, Series A no. 45, p. 19, § 43).

    So liegt es nahe, dass etwa auch Faktoren wie der zu beobachtende Fortschritt in der Medizin und die gestiegene Lebenserwartung der Menschen einen Einfluss auf die individuelle Entscheidung für die Inanspruchnahme von Sterbe- oder Suizidhilfe haben könnten (vgl. auch EGMR, Pretty v. The United Kingdom, Urteil vom 29. April 2002, Nr. 2346/02, § 65), es existieren hierzu jedoch bisher keine statistischen Erhebungen.

    In seiner Entscheidung Pretty v. The United Kingdom, die die Frage nach einem Recht auf assistierte Selbsttötung einer körperlich schwer erkrankten Person aufwarf, betont der Gerichtshof, dass die persönliche Autonomie einen wichtigen Grundsatz darstellt, welcher der Auslegung der Garantien des Art. 8 EMRK zugrunde liegt (vgl. EGMR, Pretty v. The United Kingdom, Urteil vom 29. April 2002, Nr. 2346/02, § 61).

    Staat und Gesellschaft müssen die Entscheidung, körperliches und psychisches Leiden durch eine assistierte Selbsttötung zu beenden, respektieren (vgl. EGMR, Pretty v. The United Kingdom, Urteil vom 29. April 2002, Nr. 2346/02, §§ 64 f.).

    Bei der Abwägung zwischen dem Selbstbestimmungsrecht des Einzelnen einerseits und der aus Art. 2 EMRK abgeleiteten Schutzpflicht des Staates für das Leben andererseits billigt er den Vertragsstaaten in diesem sensiblen Bereich indes einen erheblichen Einschätzungs- und Ermessensspielraum zu (vgl. EGMR, Pretty v. The United Kingdom, Urteil vom 29. April 2002, Nr. 2346/02, §§ 70 f.; Haas v. Switzerland, Urteil vom 20. Januar 2011, Nr. 31322/07, §§ 53, 55; Koch v. Deutschland, Urteil vom 19. Juli 2012, Nr. 497/09, § 70).

    Danach ist es in erster Linie Aufgabe der Vertragsstaaten, die von einer Suizidhilfe ausgehenden Risiken und Missbrauchsgefahren zu bewerten (vgl. EGMR, Pretty v. The United Kingdom, Urteil vom 29. April 2002, Nr. 2346/02, § 74).

    Danach beinhaltet das Recht auf Achtung des Privatlebens nach Art. 8 Abs. 1 EMRK das Recht auf Selbstbestimmung (EGMR, Urteil vom 29. April 2002 - Nr. 2346/02 Pretty/Vereinigtes Königreich - NJW 2002, 2851 Rn. 61).

    Daraus hat der Gerichtshof abgeleitet, dass die Entscheidung einer Person, zu vermeiden, was sie als unwürdiges und qualvolles Ende ihres Lebens ansieht, in den Anwendungsbereich von Art. 8 EMRK fällt (EGMR, Urteil vom 29. April 2002 a.a.O. Rn. 67).

    The Court would also point to its reasoning in the case of Pretty v. the United Kingdom (no. 2346/02, §§ 82-3, ECHR 2002-III), in which it did not doubt the firmness of that applicant's views concerning assisted suicide, but observed that not all opinions or convictions constitute beliefs in the sense protected by Article 9.

    Moreover, under the existing case-law the freedom to dispose of one's own body is a fundamental value that is protected by the Convention (see, for instance, Pretty v. the United Kingdom, no. 2346/02, § 66, ECHR 2002-III, and K.A. and A.D. v. Belgium, nos. 42758/98 and 45558/99, § 83, 17 February 2005).
