Par un arrêt du 20 novembre 1989 ("l'arrêt au principal"), la Cour a constaté que la condamnation du requérant pour vol à main armée, qui se fondait à un degré déterminant sur le compte rendu des déclarations de deux témoins anonymes, avait enfreint le paragraphe 3 d) de l'article 6, combiné avec le paragraphe 1 (art. 6-3-d, art. 6-1), de la Convention de sauvegarde des Droits de l'Homme et des Libertés fondamentales ("la Convention" - série A no 166, paragraphes 37-45 des motifs et point 1 du dispositif, pp. 19-21 et 23).

Nach Artikel 3 Absatz 1 des Decreto-lei Nr. 246/79 vom 25. Juli 1979 ( Diário da República I, Serie A, Nr. 170, vom 25. However, it requires in addition that any deprivation of liberty should be consistent with the purpose of Article 5 (art. 5), namely to protect individuals from arbitrariness (see, as the most recent authority, the van der Leer judgment of 21 February 1990, Series A no. 170, p. 12, § 22).Accordingly, it should have been possible to appeal against the decision of the President of the District Court in order to have the violation established and redressed (see the van der Leer judgment of 21 February 1990, Series A no. 170, p. 14, § 33), notwithstanding the non-essential nature of that violation.
