  • EGMR, 13.07.1983 - 8737/79

    Zimmermann und Steiner ./. Schweiz

    Auszug aus EGMR, 24.10.1983 - 5947/72
In these circumstances, the Court considers that in relation to this head of claim the judgment of 25 March 1983 constitutes in itself adequate just satisfaction for the applicants concerned, without it being necessary to afford financial compensation (see, as the most recent authority, the Zimmermann and Steiner judgment of 13 July 1983, Series A no. 66, p. 14, § 35).

The Court will apply the various criteria which emerge from its case-law on the subject, as regards the purpose for which the costs in question were incurred and the requirements that they be actually incurred, necessarily incurred and reasonable as to quantum (see, as the most recent authority, the above-mentioned Zimmermann and Steiner judgment, Series A no. 66, p. 14, § 36).

  • EGMR, 06.02.1981 - 6289/73

    AIREY c. IRLANDE (ARTICLE 50)

    Auszug aus EGMR, 24.10.1983 - 5947/72
With the exception of the points mentioned in paragraph 20 below, the Government did not contest that the applicants had incurred liability for costs additional to those covered by their legal aid (cf., inter alia, the Airey judgment of 6 February 1981, Series A no. 41, p. 9, § 13) and that their claim satisfied the criteria referred to in paragraph 18 above.
  • EGMR, 06.11.1980 - 6538/74

    SUNDAY TIMES c. ROYAUME-UNI (N° 1) (ARTICLE 50)

    Auszug aus EGMR, 24.10.1983 - 5947/72
The applicants also cited the award of £10,000 in respect of counsel's fees contained in the Court's Sunday Times judgment of 6 November 1980 (Series A no. 38, p. 15, § 30).
  • EGMR, 21.06.1983 - 8130/78

    Eckle./. Deutschland

    Auszug aus EGMR, 24.10.1983 - 5947/72
Although the Court is not bound by this Direction (see, mutatis mutandis, the Eckle judgment of 21 June 1983, Series A no. 65, p. 15, § 35), it agrees that these local travel expenses should not be allowed.
  • EGMR, 24.02.1983 - 7525/76

    DUDGEON c. ROYAUME-UNI (ARTICLE 50)

    Auszug aus EGMR, 24.10.1983 - 5947/72
The Court would recall that under Article 50 (art. 50) just satisfaction will be afforded only "if necessary" (see, inter alia, the Dudgeon judgment of 24 February 1983, Series A no. 59, p. 7, § 11).
  • EGMR, 25.03.1983 - 5947/72

SILVER AND OTHERS v. THE UNITED KINGDOM

    Auszug aus EGMR, 24.10.1983 - 5947/72
It also held that the refusal of a petition by Mr. Silver for permission to seek legal advice had constituted a breach of Article 6 § 1 (art. 6-1) (Series A no. 61, paragraphs 80-105 and 111-119 of the reasons and points 1, 2 and 5 of the operative provisions, pp. 31-45).
  • EGMR, 28.06.1984 - 7819/77

CAMPBELL AND FELL v. THE UNITED KINGDOM

  • EGMR, 13.07.1995 - 18139/91

TOLSTOY MILOSLAVSKY v. THE UNITED KINGDOM

41; and the Silver and Others v. the United Kingdom judgment of 24 October 1983, Series A no. 67, p. 10, para.
  • EuGH, 29.03.2001 - C-163/99

    Portugal / Kommission

Nach Artikel 18 des Decreto-lei (gesetzesvertretende Verordnung) Nr. 102/90 vom 21. März 1990 ( Diário da República I, Serie A, Nr. 67, vom 21. März 1990) werden die Flughafengebühren auf den von Aeroportos e Navegação Aérea/Empresa Pública (Öffentliches Unternehmen für Flughäfen und Flugsicherung, im Folgenden: ANA-EP) verwalteten Flughäfen durch Ministerialerlass festgesetzt.
  • EGMR, 01.03.2005 - 53487/99

    MERIAKRI v. MOLDOVA

The Court notes that it has specified in a number of cases the nature and extent of the obligations which arise for the respondent State as regards the confidentiality of a prisoner's correspondence (see, amongst many others, Silver and Others v. the United Kingdom, judgment of 25 March 1983, Series A no. 67; Campbell and Fell v. the United Kingdom, judgment of 28 June 1984, Series A no. 80; McCallum v. the United Kingdom, judgment of 30 August 1990, Series A no. 183; Campbell v. the United Kingdom, judgment of 25 March 1992, Series A no. 233; Petra v. Romania, no. 27273/95, Reports of Judgments and Decisions 1998-VII; Niedbala v. Poland, no. 27915/95, judgment of 4 July 2000 (unpublished); Rehbock v. Slovenia, no. 29462/95, Reports 2000-XII; Poltoratskiy v. Ukraine, no. 38812/97, Reports 2003-V).
  • EGMR, 24.02.2009 - 46967/07

    C.G.I.L. ET COFFERATI c. ITALIE

Dès lors, pareille demande ne saurait s'analyser en un recours dont (...) la Convention exige l'épuisement » (voir, mutatis mutandis et parmi beaucoup d'autres, Brozicek c. Italie, 19 décembre 1989, § 34, série A no 67).
  • EGMR, 02.06.2005 - 11084/02

    H.G. AND G.B. v. AUSTRIA

In exercising the discretion thus conferred on it, the Court will have regard to what is equitable in all the circumstances of the case (Silver and Others (Article 50), 24 October 1983, Series A no. 67, para 9).
  • EGMR, 04.06.2002 - 37471/97

WILLIAM FAULKNER v. THE UNITED KINGDOM

In these circumstances, the Court considers that the finding of violation is sufficient just satisfaction (see the Silver and Others v. the United Kingdom (Article 50) judgment of 24 October 1983, Series A no. 67, § 10 and the Campbell v. the United Kingdom judgment of 25 March 1992, Series A no. 233, § 70).
  • EGMR, 20.06.1988 - 11368/85

    SCHÖNENBERGER AND DURMAZ v. SWITZERLAND

The contested stopping of the letter may have obstructed the applicants and aroused in them a certain feeling of frustration, but not to the extent of requiring an award of damages; the finding of a violation of Article 8 (art. 8) in itself constitutes adequate just satisfaction in this respect (see, mutatis mutandis the Silver and Others judgment of 24 October 1983, Series A no. 67, p. 6, § 10).
  • EGMR, 31.03.2009 - 33/04

    FACCIO c. ITALIE

Italie, 19 décembre 1989, § 34, série A no 67).
