KOSTOVSKI v. THE NETHERLANDS
Auszug aus EGMR, 01.02.2018 - 27962/10
However, regarding anonymous witnesses the Court has also found that the nature and scope of those questions were considerably restricted by reason of the trial court's decision that the anonymity of the witnesses should be preserved (see Kostovski v. the Netherlands, 20 November 1989, § 42, Series A no. 166). - EGMR, 10.04.2012 - 8088/05

SNIJDERS v. THE NETHERLANDS
The Court reiterates that in the case of a fully anonymous witness, where no details whatsoever as to the witness' identity or background are known, the defence faces the difficulty of being unable to put to the witness any reasons which the witness may have for lying (see Asani v. the former Yugoslav Republic of Macedonia, no. 27962/10, § 36, 1 February 2018).It also reiterates, and rightly so, that in the case of a fully anonymous witness, where no details whatsoever as to the witness' identity or background are known, the defence faces the difficulty of being unable to put to the witness any reasons which the witness may have for lying (see Asani v. the former Yugoslav Republic of Macedonia, no. 27962/10, § 36, 1 February 2018).
- EGMR, 28.11.2023 - 37404/18
OGUZ v. TÜRKIYE
In particular, the absence of an explicit objection by the applicant to the statements of the anonymous witness being read out at the hearing cannot be interpreted as an unequivocal waiver on his part of the right to examine this witness (compare also Asani v. the former Yugoslav Republic of Macedonia, no. 27962/10, § 52, 1 February 2018). - EGMR, 29.03.2022 - 24481/15
ANDI MARIUS IONESCU c. ROUMANIE
- EGMR, 08.02.2022 - 49951/16
TORJ c. ROUMANIE
Allemagne [GC] no 9154/10, §§ 100-130, CEDH 2015 et Asani c. l'ex-Republique yougoslave de Macédoine, no 27962/10, §§ 36-37, 1er février 2018). - EGMR, 04.06.2020 - 71034/13
BOSHKOSKI v. NORTH MACEDONIA
They can be viewed, therefore, as specific aspects of the concept of a fair trial in criminal proceedings in Article 6 § 1 (see, for example, Ibrahim and Others v. the United Kingdom [GC], nos. 50541/08 and 3 others, §§ 250-52, 13 September 2016; Gäfgen v. Germany [GC], no. 22978/05, § 169, ECHR 2010; Schatschaschwili, cited above, § 100; and Asani v. the former Yugoslav Republic of Macedonia, no. 27962/10, § 32, 1 February 2018).
