STEEL ET MORRIS c. ROYAUME-UNI
Auszug aus EGMR, 01.03.2011 - 1236/05
It is central to the concept of a fair trial, in civil as in criminal proceedings, that a litigant is not denied the opportunity to present his or her case effectively before the court and that he or she is able to enjoy equality of arms with the opposing side (see Steel and Morris v. the United Kingdom, no. 68416/01, § 59, ECHR 2005-II). - EGMR, 17.07.2007 - 52658/99
MEHMET AND SUNA YIGIT v. TURKEY
Auszug aus EGMR, 01.03.2011 - 1236/05
Article 6 § 1 leaves to the State a free choice of the means to be used towards this end but, while the Contracting States enjoy a certain margin of appreciation in that respect, the ultimate decision as to the observance of the Convention's requirements rests with the Court (see Kreuz v. Poland, no. 28249/95, § 53, ECHR 2001-VI, and Mehmet and Suna YiÄ?it v. Turkey, no. 52658/99, § 33, 17 July 2007).

URBSIENE AND URBSYS v. LITHUANIA
It is central to the concept of a fair trial, in civil as in criminal proceedings, that a litigant is not denied the opportunity to present his case effectively to the courts and that he is able to enjoy equality of arms with the opposing side (see Steel and Morris v. the United Kingdom, no. 68416/01, § 59, ECHR 2005-II, N.J.D.B. v. the United Kingdom, no. 76760/12, § 71, 27 October 2015, and Kaba v. Turkey, no. 1236/05, § 19, 1 March 2011). - EGMR, 14.12.2021 - 13761/17
ERSOY v. TURKEY
The Court further observes that it has already examined similar grievances in the past and has found a violation of Article 6 § 1 of the Convention on the grounds, inter alia, that the legal aid system in Turkey fails to offer individuals substantial guarantees to protect them from arbitrariness (see, in particular, Bakan v. Turkey, no. 50939/99, §§ 74-78, 12 June 2007; Mehmet and Suna Yigit v. Turkey, no. 52658/99, §§ 31-39, 17 July 2007; Eyüp Kaya v. Turkey, no. 17582/04, §§ 22-26, 23 September 2008; Kaba v. Turkey, no. 1236/05, §§ 19-25, 1 March 2011; and Ilbeyi Kemaloglu and Meriye Kemaloglu v. Turkey, no. 19986/06, § 52, 10 April 2012). - EGMR, 28.01.2014 - 9564/13
FATIH PRES SAN. VE TIC. LTD. STI. v. TURKEY
The Court reiterates that it has already examined grievances with regard to domestic courts" refusal of legal aid and has found a violation of Article 6 § 1 of the Convention on the ground, inter alia, that the legal aid system in Turkey failed to offer individuals substantial guarantees to protect them from arbitrariness (see Bakan v. Turkey, no. 50939/99, §§ 74-78, 12 June 2007; Mehmet and Suna YiÄ?it v. Turkey, no. 52658/99, §§ 33-39, 17 July 2007; Eyüp Kaya v. Turkey, no. 17582/04, §§ 22-26, 23 September 2008; and Kaba v. Turkey, no. 1236/05, §§ 19-25, 1 March 2011). - EGMR, 25.06.2013 - 42415/09
TÜRKOGLU DEMIR SAN. VE TIC. LTD. STI. AND OTHERS v. TURKEY
The question whether the provision of legal aid is necessary for a fair hearing must be determined on the basis of the particular facts and circumstances of each case and will depend, inter alia, upon the importance of what is at stake for the applicant in the proceedings, the complexity of the relevant law and procedure and the applicant's capacity to represent him or herself effectively (see Alkan v. Turkey, no. 17725/07, § 24, 7 February 2012; Serap Demirci v. Turkey, no. 316/07, § 25, 10 January 2012, and Kaba v. Turkey, no. 1236/05, § 20, 1 March 2011).
