    FRYDLENDER c. FRANCE

    Auszug aus EGMR, 01.12.2005 - 33914/02
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII).

    YAGCI AND SARGIN v. TURKEY

    Auszug aus EGMR, 01.12.2005 - 33914/02
Irrespective of the reasons for the applicant's decision, the Court reiterates that the applicant cannot be blamed for taking full advantage of the resources afforded by national law in the defence of her interest (see, mutatis mutandis, YaÄ?cı and Sargın v. Turkey, judgment of 8 June 1995, Series A no. 319-A, § 66).
  • EGMR, 09.10.2008 - 62936/00

    MOISEYEV v. RUSSIA

As regards his challenges to judicial officers and procedural requests, the Court reiterates that the applicant cannot be blamed for taking full advantage of the resources afforded by national law in the defence of his or her interest (see Skorobogatova v. Russia, no. 33914/02, § 47, 1 December 2005).

    BROVCHENKO v. RUSSIA

As regards his procedural requests, the Court reiterates that the applicant cannot be blamed for taking full advantage of the resources afforded by national law in the defence of his or her interest (see Skorobogatova v. Russia, no. 33914/02, § 47, 1 December 2005).

    MÜLLER v. GERMANY

  • EGMR, 13.07.2006 - 4856/03

    DUBINSKAYA v. RUSSIA

In this respect, the Court reiterates that judicial proceedings are considered to be pending until the parties are definitely able to find out the content of the written judgment in the determination of the merits of a dispute or a decision on discontinuation of the proceedings (cf. Skorobogatova v. Russia, no. 33914/02, §§ 39-40, 1 December 2005, Shatunov and Shatunova v. Russia (dec.), no. 31271/02, 30 June 2005 and, mutatis mutandis, Papachelas v. Greece [GC], no. 31423/96, § 30, ECHR 1999-II).
