CHARZYNSKI c. POLOGNE
Auszug aus EGMR, 01.12.2009 - 24676/07
The relevant domestic law and practice concerning remedies for excessive length of judicial proceedings, in particular the applicable provisions of the 2004 Act, are stated in the Court's decisions in the cases of Charzynski v. Poland no. 15212/03 (dec.), §§ 12-23, ECHR 2005-V, and Ratajczyk v. Poland no. 11215/02 (dec.), ECHR 2005-VIII, and the judgment in the case of Krasuski v. Poland, no. 61444/00, §§ 34-46, ECHR 2005-V.In particular it has considered that that remedy is capable both of preventing the alleged violation of the right to a hearing within a reasonable time or its continuation, and of providing adequate redress for any violation that has already occurred (see Charzynski v. Poland (dec.), no. 15212/03, §§ 36-42, ECHR 2005-V).

BAK v. POLAND
Auszug aus EGMR, 01.12.2009 - 24676/07
Having regard to the foregoing and noting that the case did not belong to the category of organised crime (compare Bak v. Poland, no. 7870/04, ECHR 2007-... (extracts)), the Court concludes that the grounds given by the domestic authorities could not justify the extraordinarily long period of the applicant's detention.

KOWALCZYK v. POLAND
Moreover, had he considered that his financial situation deteriorated, or was incorrectly assessed, it was open to the applicant to lodge another complaint under the 2004 Act together with another request for exemption from the court fee, this time with appropriate proof of his financial situation (see Druzkowski v. Poland, no. 24676/07, § 41, 1 December 2009). - EGMR, 14.02.2012 - 25543/09
DUDA v. POLAND
Accordingly, the applicant did not make use of the relevant remedy in compliance with the formal requirements laid down in domestic law (see, mutatis mutandis, Komorowska v. Poland (dec.), no. 38226/03, 10 June 2008; and Druzkowski v. Poland, no. 24676/07, § 41, 1 December 2009).
