Das Urteil Delcourt vom 17. Januar 1970 erkennt grundsätzlich an, dass der Schutz des Art. 6 nicht mit dem erstinstanzlichen Urteil endet (Série A Nr. 11, S. 14 f., Ziff. 25, EGMR-E 1, 101): "Über eine strafrechtliche Anklage ist solange nicht wirklich "entschieden" (determined), wie die Verurteilung oder der Freispruch nicht rechtskräftig sind.56. Die Art und Weise, wie Art. 6 Abs. 1 und 3 lit. c im Berufungs- oder Revisionsverfahren anzuwenden sind, hängt von den Besonderheiten des jeweiligen Verfahrens ab (vgl. u.a. Urteil Delcourt, Série A Nr. 11, S. 15, Ziff. 26, EGMR-E 1, 101 f., und Urteil Pakelli vom 25. April 1983, Série A Nr. 64, S. 14, Ziff. 29, EGMR-E 2, 278).

Zunächst ist festzustellen, dass der Grundsatz der Waffengleichheit, der dem in Art. 6 Abs. 1 niedergelegten Begriff der Fairness inhärent ist (Urteil Delcourt, a.a.O., Série A Nr. 11, S. 15, Ziff. 28, EGMR-E 1, 102), gewahrt wurde, da sowohl der Einzelrichter als auch die Kammer des Berufungsgerichts die Anklagevertretung nicht in größerem Umfang angehört haben als die beiden Betroffenen.

Der Gerichtshof respektiert dabei die unterschiedliche Ausgestaltung der Rechtsmittelzüge in den Vertragsstaaten, die entweder eine vorgelagerte Annahmeentscheidung voraussetzen, für die der Öffentlichkeitsgrundsatz ohnehin nicht gilt (vgl. EGMR, Monnell and Morris v. United Kingdom, Urteil vom 2. März 1987, Nr. 9562/81 und 9818/82, § 58), oder eine andere, vergleichbare Möglichkeit zur vereinfachten Erledigung aussichtsloser Rechtsmittel vorsehen (vgl. EGMR, Bulut v. Austria, Urteil vom 22. EKBATANI v. SWEDEN
La procédure pénale forme un tout et la protection de l'article 6 (art. 6) ne cesse pas avec le jugement de première instance: selon la jurisprudence de la Cour, un État qui se dote de cours d'appel ou de cassation a l'obligation de veiller à ce que les justiciables jouissent auprès d'elles des garanties fondamentales du texte précité (voir en dernier lieu l'arrêt Monnell et Morris du 2 mars 1987, série A no 115, p. 21, § 54).14-15, §§ 27 et 29; voir aussi l'arrêt Monnell et Morris précité, série A no 115, p. 22, § 58).
Les modalités d'application de ce dernier en appel dépendent toutefois des particularités de la procédure dont il s'agit; il faut prendre en compte l'ensemble du procès mené dans l'ordre juridique interne et le rôle qu'y a joué la juridiction d'appel (voir en dernier lieu l'arrêt Monnell et Morris précité, série A no 115, p. 22, § 56).
Pour le savoir, il échet d'étudier la nature du système d'appel suédois, l'étendue des pouvoirs de la cour d'appel et la manière dont les intérêts du requérant ont été réellement exposés et protégés devant elle (voir, mutatis mutandis, l'arrêt Monnell et Morris précité, série A no 115, p. 22, § 56).
Ce principe ne constitue toutefois, il y a lieu de le rappeler, "qu'un aspect de la notion plus large de procès équitable" (voir, entre autres, l'arrêt Monnell et Morris précité, série A no 115, p. 94, § 62).
Ainsi, les procédures d'autorisation d'appel, ou consacrées exclusivement à des points de droit et non de fait, peuvent remplir les exigences de l'article 6 (art. 6) même si la cour d'appel ou de cassation n'a pas donné au recourant la faculté de s'exprimer en personne devant elle (voir entre autres l'arrêt Monnell et Morris précité, série A no 115, p. 22, § 58, pour l'autorisation d'appel, et l'arrêt Sutter du 22 février 1984, série A no 74, p. 13, § 30, pour la cour de cassation).

9562/81 and 9818/82 Monnell and Morris v. the United Kingdom, adopted on 11 March 1985, and the Delcourt judgment of the Court (Series A No. 11) the Government accept that the guarantees provided by Article 6 apply to applications for leave to appeal to the Court of Appeal Criminal Division.The applicant relies on the Report of the Commission of 11 March 1985 in MONNELL and MORRIS v. the United Kingdom (Applications Nos. 9562/81 and 9818/82) and adopts the substance of the arguments presented on behalf of the applicants Monnell and Morris in support of his argument that the absence of the applicant and his lack of representation at the hearings of his applications for leave to appeal against sentence and conviction before the single judge and full Court of Appeal both which had the power to make orders for loss of time counting towards sentence deprived him of a fair trial within the meaning of Article 6 para.
Thus, the Commission considers that, although Article 6 (Art. 6) does not guarantee an appeal in criminal proceedings, where the opportunity to lodge an appeal in regard to the determination of a criminal charge is provided under domestic law, the guarantees of Article 6 (Art. 6) continue to apply to the appeal proceedings, since those proceedings form part of the whole proceedings which determine the criminal charge at issue (No. 9315/81, Dec. 15.7.83, D.R. 34 p. 96, and Monnell and Morris v. the United Kingdom, Nos. 9562/81 and 9818/82, Comm. Rep. 11.3.85).
