The right to take such proceedings is guaranteed by Article 5 § 4 of the Convention, and the result required by Article 5 § 4 could in certain cases be attained if a detainee appeared in person before a court deciding on the lawfulness of that detention (see e.g., Eur. Court H.R., Sanchez-Reisse v. Switzerland judgment of 21 October 1986, Series A no. 107, p. 19, § 51).
