BLADET TROMSØ ET STENSAAS c. NORVEGE
- EGMR, 23.09.1994 - 15890/89
JERSILD v. DENMARK

- EGMR, 25.11.1999 - 23118/93
NILSEN AND JOHNSEN v. NORWAY
France [GC], n° 29183/95, § 54, CEDH 1999-I).

BJÖRK EIÐSDÓTTIR v. ICELAND
The most careful scrutiny on the part of the Court is called for when, as in the present case, the measures taken or sanctions imposed by the national authority are capable of discouraging the participation of the press in debates over matters of legitimate public concern (see Jersild, cited above, pp. 25-26, § 35; and Bergens Tidende and Others v. Norway, no. 26132/95, § 52, ECHR 2000-IV, Tønsbergs Blad A.S. and Haukom, cited above, § 88; compare MGN Limited v. the United Kingdom, no. 39401/04, §§ 150 and 155, 18 January 2011; Von Hannover v. Germany (no. 2) [GC], nos.It is further to be observed that in Vikan's issue no. 34, the applicant's interview with Mrs Z was presented with certain counter-balancing elements (see Jersild, cited above, § 34, and Bergens Tidende and Others v. Norway, no. 26132/95, § 58, ECHR 2000-IV).
- EGMR, 06.09.2005 - 65518/01
SALOV v. UKRAINE
Norvège, no 26132/95, § 50, CEDH 2000-IV). - EGMR, 02.06.2015 - 54145/10
ERLA HLYNSDÓTTIR v. ICELAND (No. 3)
The most careful scrutiny on the part of the Court is called for when, as in the present case, the measures taken or sanctions imposed by the national authority are capable of discouraging the participation of the press in debates over matters of legitimate public concern (see Björk Eiðsdóttir, cited above, § 69; see also Jersild, cited above, § 35; Bergens Tidende and Others v. Norway, no. 26132/95, § 52, ECHR 2000-IV; Tønsbergs Blad A.S. and Haukom, cited above, § 88; compare MGN Limited v. the United Kingdom, no. 39401/04, §§ 150 and 155; 18 January 2011; Von Hannover, cited above, §§ 106-107; and Axel Springer AG, cited above, §§ 87-88, 7 February 2012).
- EGMR, 01.03.2007 - 510/04
TØNSBERGS BLAD AS AND HAUKOM v. NORWAY
Norvège, no 26132/95, § 52, CEDH 2000-IV). - EGMR, 25.03.2021 - 1864/18
MATALAS v. GREECE
Accordingly, the accusations attained a level of seriousness sufficient to harm L.P."s rights under Article 8 of the Convention (see, mutatis mutandis, Bergens Tidende and Others v. Norway, no. 26132/95, § 51, ECHR 2000-IV, and Kanellopoulou v. Greece, no. 28504/05, § 38, 11 October 2007, both of which concerned accusations made against doctors). - EGMR, 10.07.2012 - 43380/10
ERLA HLYNSDÓTTIR v. ICELAND
However, in the Court's view it is not clear that these had as their common sting (see Bergens Tidende and Others v. Norway, no. 26132/95, § 56, ECHR 2000-IV) a suggestion that Mr A was "in charge of... an international crime organisation". - EGMR, 27.07.2021 - 29856/13
SIC - SOCIEDADE INDEPENDENTE DE COMUNICAÇÃO v. PORTUGAL
There is no doubt that the impugned news reports conveyed information of public interest (compare Bergens Tidende and Others v. Norway, no. 26132/95, § 51, ECHR 2000-IV; Colaço Mestre and SIC - Sociedade Independente de Comunicação, S.A. v. Portugal, nos. - EGMR, 02.10.2018 - 7972/09
FEDCHENKO v. RUSSIA (No. 3)
These factors, in turn, require consideration of other elements such as the authority of the source (ibid.), whether the newspaper conducted a reasonable amount of research before publication (Prager and Oberschlick, cited above, § 37), whether the newspaper presented the story in a reasonably balanced manner (Bergens Tidende and Others v. Norway, no. 26132/95, § 57, ECHR 2000-IV) and whether the newspaper gave the persons defamed the opportunity to defend themselves (ibid., § 58). - EGMR, 13.01.2015 - 34447/05
MARIAN MACIEJEWSKI v. POLAND
These factors, in turn, require consideration of other elements such as the authority of the source (Bladet Tromsø and Stensaas, cited above), whether the newspaper had conducted a reasonable amount of research before publication (Prager and Oberschlick v. Austria, 26 April 1995, § 37, Series A no. 313), whether the newspaper presented the story in a reasonably balanced manner (Bergens Tidende and Others v. Norway, no. 26132/95, § 57, ECHR 2000-IV) and whether the newspaper gave the persons defamed the opportunity to defend themselves (Bergens Tidende and Others, cited above, § 58). - EGMR, 21.10.2014 - 54125/10
ERLA HLYNSDÓTTIR v. ICELAND (No. 2)
Referring to Jersild v. Denmark (23 September 1994, Series A no. 298); Observer and Guardian v. the United Kingdom (26 November 1991, Series A no. 216); and Bergens Tidende and Others v. Norway (no. 26132/95, ECHR 2000-IV), the applicant pointed out that it was the well-established case-law of the Court that news reporting based on interviews, edited or not, constituted one of the most important means whereby the press was able to play its vital role of "public watchdog". - EGMR, 09.11.2006 - 72331/01
