Thus, the interference with property rights in the present case can be examined as a constituent element of the procedure for controlling the use of goods subject to excise duty (see, mutatis mutandis, AGOSI v. the United Kingdom, 24 October 1986, § 51, Series A no. 108, and Bowler International Unit v. The Court reiterates that, from the Convention standpoint, an applicant who has exhausted a remedy that is apparently effective and sufficient cannot be required also to have tried others that were available but probably no more likely to be successful (see Aquilina v. Malta [GC], no. 25642/94, § 39, ECHR 1999-III).
