Auszug aus EGMR, 04.11.2010 - 14480/08
The Court who is the master of the characterisation to be given in law to the facts of the case (see, for example, Scoppola v. Italy (no. 2) [GC], no. 10249/03, § 54, ECHR 2009-...) deems it appropriate to examine the case under Article 14 taken in conjunction with Article 1 of Protocol No. 1.

DAMJANAC v. CROATIA
Furthermore, the Court is not prevented from examining the manner in which international agreements on social policy and pensions have affected an individual's situation at the domestic level (see Tarkoev and Others v. Estonia, nos. 14480/08 and 47916/08, §§ 61-65, 4 November 2010). - EGMR, 14.06.2011 - 20511/04
PURICEL v. ROMANIA
Because of their direct knowledge of their society and its needs, the national authorities are in principle better placed than the international judge to appreciate what is in the public interest on social or economic grounds, and the Court will generally respect the legislature's policy choice unless it is "manifestly without reasonable foundation" (Stec and Others v. the United Kingdom, [GC], nos. 65731/01 and 65900/01, § 52, ECHR 2006 Tarkoev and Others v. Estonia, nos. 14480/08 and 47916/08, § 58, 4 November 2010).
