"Possessions" can be "existing possessions" or assets, including claims, in respect of which an applicant can argue that he has at least a "legitimate expectation" (which must be of a more concrete nature than a mere hope) that they will be realised, that is that he or she will obtain effective enjoyment of a property right (see, inter alia, Gratzinger and Gratzingerova v. the Czech Republic (dec.) The purpose of Article 35 is to afford the Contracting States the opportunity of preventing or putting right violations alleged against them before those allegations are submitted to the Court (see, for example, Gherghina, cited above, § 84; Hentrich v. France, 22 September 1994, § 33, Series A no. 296-A, and Remli v. France, 23 April 1996, § 33, Reports of Judgements and Decisions 1996-II).
