  • EGMR, 12.06.2012 - 54131/10

Asyl, Widerruf, Achtung des Familienlebens, Refoulement, subsidiärer Schutz,

    Auszug aus EGMR, 05.09.2013 - 61204/09
Nevertheless, the Court considers that the unsafe general situation there is not sufficiently serious to conclude that the return of the applicants to Russia would amount to a violation of Article 3 of the Convention (see, for example Bajsultanov v. Austria, no. 54131/10, §§ 64-72, 12 June 2012 and Jeltsujeva v. the Netherlands (dec.), no. 39858/04, 1 June 2006).

Finally, the majority did not attach sufficient importance to the fact that the case concerns expulsion to a High Contracting Party to the Convention, which has undertaken to secure the fundamental rights guaranteed by it (see, as a recent authority with respect to Chechnya, Bajsultanov v. Austria, no. 54131/10, § 70, 12 June 2012).

    Auszug aus EGMR, 05.09.2013 - 61204/09
Having regard to its case-law concerning disappearances and ill-treatment in Chechnya (see, among many others, Bazorkina v. Russia, no. 69481/01, 27 July 2006; Imakayeva v.
