Selon le Gouvernement, l'arrêt rendu par la Cour dans l'affaire X c. Royaume-Uni (arrêt du 5 novembre 1981, série A no 46) se distingue de l'espèce dans la mesure où le contrôle dont il s'agissait portait sur une décision de détention prise sur la base de dispositions législatives tandis que la présente cause concerne le contrôle d'une décision d'internement fondée sur la common law.
