DURRECHE c. FRANCE
Faisant valoir à cet égard que le requérant rémunère lui-même son avocat, le Gouvernement rappelle à ce propos que la Cour avait pris en considération cet élément dans sa décision d'irrecevabilité Arvanitakis c. France du 5 décembre 2000 (no 46275/99, CEDH 2000-XII).Par la suite, il n'a plus procédé à l'exécution, au moins partielle, de l'arrêt de condamnation, exécution qui, dans le cas d'espèce, n'apparaissait pas totalement irréalisable, preuve en est, notamment, le versement des honoraires de son avocat (voir Arvanitakis c. France (déc.), no 46275/99, CEDH 2000-XII).

BOER AUGSBURGER contre l'ESPAGNE
La Cour rappelle que le «droit à un tribunal», dont le droit d'accès constitue un aspect particulier, n'est pas absolu et se prête à des limitations implicitement admises, notamment quant aux conditions de recevabilité d'un recours, car il appelle de par sa nature même une réglementation par l'État, lequel jouit à cet égard d'une certaine marge d'appréciation (voir, parmi d'autres, les arrêts Edificaciones March Gallego S.A. c. Espagne du 19 février 1998, Recueil des arrêts et décisions 1998-I, p. 290, § 34, et Garcia Manibardo c. Espagne, n° 38695/97, § 36, CEDH 2000-II, Arvanitakis c.
