d) Article 5 § 4 requires that the procedure followed have a judicial character and give to the individual concerned guarantees appropriate to the kind of deprivation of liberty in question; in order to determine whether a proceeding provides adequate guarantees, regard must be had to the particular nature of the circumstances in which such proceeding takes place (see Megyeri v. Admittedly, deprivation of liberty can fall within the ambit of both Article 5 § 1 (a) and Article 5 § 1 (e) but no problem arises in the present case as regards compliance with the requirements of sub-paragraph a (see X v. the United Kingdom, judgment of 5 November 1981, Series A no. 46, pp. 17-18, § 39).
