Menschenrechte: Überlange Untersuchungshaft, "La Belle"
Auszug aus EGMR, 06.02.2014 - 48613/06
As regards the danger of the applicant's absconding, the Court observes that the possibility of a severe sentence alone is not sufficient after a certain lapse of time to justify continued detention based on the danger of flight (see, among other numerous authorities, Chraidi v. Germany, no. 65655/01, § 40, ECHR 2006-XII, and Shikuta v. Russia, no. 45373/05, § 45, 11 April 2013). - EGMR, 11.04.2013 - 45373/05

Auszug aus EGMR, 06.02.2014 - 48613/06
Continued detention can be justified in a given case only if there are actual indications of a genuine requirement of public interest which, notwithstanding the presumption of innocence, outweighs the rule of respect for individual liberty laid down in Article 5 of the Convention (see, among other authorities, Kudla v. Poland [GC], no. 30210/96, §§ 110 et seq., ECHR 2000-XI). - EGMR, 21.12.2000 - 33492/96

EL KHOURY v. GERMANY
Polen [GK], Individualbeschwerde Nr. 30210/96, Rdnr. 110, ECHR 2000-XI; Zimin./. Russland, Individualbeschwerde Nr. 48613/06, Rdnr. 30, 6. Februar 2014). - EGMR, 05.07.2016 - 50130/12
BANDUR v. HUNGARY
Continued detention can only be justified in a given case if there are actual indications of a genuine requirement of public interest which, notwithstanding the presumption of innocence, outweighs the rule of respect for individual liberty laid down in Article 5 of the Convention (see Kudla v.
