Having regard to the finding of a violation under Article 8 as a result of the failure of the domestic courts to comprehensively examine the applicant's claims, the Court considers that it is not necessary to examine whether, in this case, there has also been a violation of Article 1 of Protocol No. 1 to the Convention (see, mutatis mutandis, Babylonová v.
