  By a judgment of 19 February 1997, published in the Official Gazette (Diário da República) of 30 April 1997, the Constitutional Court, referring to the European Court's judgment in Lamy v. Belgium (judgment of 30 March 1989, Series A no. 151), ruled that these provisions would be contrary to the Constitution if interpreted in such a way as to deny access to the case-file to an accused who wished to challenge the prosecution's views on the lawfulness of the detention.

  The persistence of reasonable suspicion that the person arrested has committed an offence is a condition sine qua non for the validity of the continued detention (see the Stögmüller v.
