GORYAYNOVA v. UKRAINE
Auszug aus EGMR, 06.07.2021 - 41387/17
This is particularly true where the employee concerned is the only person, or part of a small category of people, aware of what is happening at work and is thus best placed to act in the public interest by alerting the employer or the public at large (see Guja v. Moldova [GC], no. 14277/04, § 72, ECHR 2008; and Goryaynova v. Ukraine, no. 41752/09, §§ 49-50, 8 October 2020). - EGMR, 10.03.2009 - 3002/03

S.W. c. ROYAUME-UNI
Auszug aus EGMR, 06.07.2021 - 41387/17
The Court emphasises at the outset that the common law nature of the offence of misconduct in public office does not in itself give rise to any particular concerns under Article 7. The Court's case-law makes clear that Article 7 does not require a criminal offence to be placed on a statutory footing (see, for example, Dallas, cited above, and S.W. v. the United Kingdom, 22 November 1995, Series A no. 335-B, where the Court found no violation in cases concerning common law offences). - EGMR, 11.02.2016 - 38395/12
DALLAS v. THE UNITED KINGDOM
Auszug aus EGMR, 06.07.2021 - 41387/17
This requirement is satisfied where the individual can know from the wording of the relevant provision, if need be with the assistance of the courts" interpretation of it and after taking appropriate legal advice, what acts and omissions will make him criminally liable (see Del Río Prada v. Spain [GC], no. 42750/09, §§ 77-80 and 91, ECHR 2013; and Dallas v. the United Kingdom, no. 38395/12, § 69, 11 February 2016, with further references).

- EGMR, 12.10.2023 - 34634/18
TOTAL S.A. ET VITOL S.A. c. FRANCE
Lettonie [GC], no 36376/04, § 185, CEDH 2010, Streletz, Kessler et Krenz c. Allemagne [GC], nos 34044/96 et 2 autres, § 50, CEDH 2001-II, et Norman c. Royaume-Uni, no 41387/17, §§ 60 et 66, 6 juillet 2021). - EGMR, 18.07.2023 - 26360/19
MANOLE c.
Royaume-Uni, no 41387/17, § 89, 6 juillet 2021). - EGMR, 06.12.2022 - 8115/15
DOBRILA v. ROMANIA
The general principles emerging from the Court's case-law under Article 7 of the Convention are summarised in Del Río Prada v. Spain ([GC], no. 42750/09, §§ 91-93, ECHR 2013), and, more recently, in Norman v. the United Kingdom (no. 41387/17, §§ 59-61, 6 July 2021).
