Where the proprietary interest is in the nature of a claim it may be regarded as an "asset" only where it has a sufficient basis in national law or if it is sufficiently established by a final and enforceable judicial decision (see Kopecký v. Slovakia [GC], no. 44912/98, §§ 52, ECHR 2004-IX, and Stran Greek Refineries and Stratis Andreadis v. Greece, judgment of 9 December 1994, Series A no. 301-B, p. 84, § 59).
