The Court recalls that it is not its function to deal with errors of fact or law allegedly committed by a national court, unless and in so far as they may have infringed rights and freedoms protected by the Convention (see Garcia Ruiz v. Where the proprietary interest is in the nature of a claim it may be regarded as an "asset" only where it has a sufficient basis in national law or if it is sufficiently established by a final and enforceable judicial decision (see Kopecký v. Slovakia [GC], no. 44912/98, §§ 52, ECHR 2004-IX, and Stran Greek Refineries and Stratis Andreadis v. Greece, judgment of 9 December 1994, Series A no. 301-B, p. 84, § 59).
