38. The Court reiterates that in order to be able to rely on the substantive provisions of the Convention, two conditions must be met: an applicant must fall into one of the categories of petitioners mentioned in Article 34 of the Convention, and he or she must be able to make out a prima facie case that he or she is the victim of a violation of the Convention ( Asselbourg and Others v. 48. The Court recalls that the term "victim" used in Article 34 denotes the person directly affected by the act or omission which is at issue (see Eckle v. Germany , judgment of 15 July 1982, Series A no. 51, p. 30, § 66).
