GROPPERA RADIO AG ET AUTRES c. SUISSE
Auszug aus EGMR, 07.11.2000 - 44802/98
In assessing whether the restriction is proportionate to the aim pursued, the Court observes that States have a margin of appreciation in this area, subject, however, to strict supervision because of the importance of the right to freedom of expression (see the Groppera Radio AG and Others v. Switzerland judgment of 20 June 1989, Series A no. 173, § 61, and the above-mentioned Informationsverein Lentia and Others judgment, § 35). - EGMR, 22.05.1990 - 12726/87
AUTRONIC AG v. SWITZERLAND
Auszug aus EGMR, 07.11.2000 - 44802/98
Although broadcasting enterprises have no guarantee of any right to a licence under the Convention, the rejection by a State of a licence application must not be manifestly arbitrary or discriminatory and the necessity for any restriction must be convincingly established (see the Autronic AG v. Switzerland judgment of 22 May 1990, Series A no. 178, § 61, and No. 10746/94, Dec. 16.10.86, D.R. 49, p. 126). - EGMR, 25.05.1993 - 14307/88
KOKKINAKIS c. GRÈCE
Auszug aus EGMR, 07.11.2000 - 44802/98
It is well-established in the Court's case-law under Article 9 of the Convention that in democratic societies, in which several religions coexist within one and the same population, it may be necessary to place restrictions on the freedom to manifest one's religion or beliefs in order to reconcile the interests of the various groups and ensure that everyone's beliefs are respected (see the Kokkinakis v. Greece judgment of 25 May 1993, Series A no. 260-A, § 33). - EGMR, 24.11.1993 - 13914/88
INFORMATIONSVEREIN LENTIA AND OTHERS v. AUSTRIA
Auszug aus EGMR, 07.11.2000 - 44802/98
The Court recalls that the third sentence of Article 10 § 1 permits States to regulate broadcasting by a licensing system based on such criteria as the nature and objectives of the proposed station and its potential audience (see the Informationsverein Lentia and Others v. Austria judgment of 24 November 1993, Series A no. 276, § 32).

CENTRO EUROPA 7 S.R.L. AND DI STEFANO v. ITALY
The Court has held that the refusal to grant a broadcasting licence constitutes interference with the exercise of the rights guaranteed by Article 10 § 1 of the Convention (see, among other authorities, Informationsverein Lentia and Others, cited above, § 27; Radio ABC v. Austria, 20 October 1997, § 27, Reports 1997-VI; Leveque v. France (dec.), no. 35591/97, 23 November 1999; United Christian Broadcasters Ltd v. the United Kingdom (dec.), no. 44802/98, 7 November 2000; Demuth v. Switzerland, no. 38743/97, § 30, ECHR 2002-IX; and Glas Nadezhda EOOD and Anatoliy Elenkov, cited above, § 42). - EGMR, 17.06.2008 - 32283/04
MELTEX LTD AND MOVSESYAN v. ARMENIA
Such refusals constituted interferences with the applicant company's freedom to impart information and ideas (see Grauso v. Poland, no. 27388/05, Commission decision of 9 April 1997, unreported; and also, mutatis mutandis, Verein Alternatives Lokalradio Bern and Verein Radio Dreyeckland Basel v. Switzerland, no. 10746/84, Commission decision of 16 October 1986, Decisions and Reports (DR) 49, p. 126; Informationsverein Lentia and Others v. Austria, judgment of 24 November 1993, Series A no. 276, p. 13, § 27; Radio ABC v. Austria, judgment of 20 October 1997, Reports of Judgments and Decisions 1997-VI, p. 2197, § 27; Brook v. the United Kingdom (dec.), no. 38218/97, 11 July 2000; United Christian Broadcasters Ltd v. the United Kingdom (dec.), no. 44802/98, 7 November 2000; and Demuth v. Switzerland, no. 38743/97, § 30, ECHR 2002-IX).
