VAN DER MUSSELE c. BELGIQUE
Auszug aus EGMR, 07.11.2000 - 47500/99
Although the application of Article 14 does not necessarily presuppose a breach of those provisions - and to this extent it has an autonomous meaning -, there can be no room for its application unless the facts at issue fall within the ambit of one or more of the latter (see, inter alia, the Van der Mussele judgment v. Belgium of 23 November 1983, Series A no. 70, p. 22, § 43). - EGMR, 28.06.1984 - 7819/77
CAMPBELL AND FELL v. THE UNITED KINGDOM
Auszug aus EGMR, 07.11.2000 - 47500/99
The Court already examined similar problems in two cases relating to military disciplinary proceedings (see the Engel and others v. the Netherlands judgment of 8 June 1976, Series A no. 22) and to prison disciplinary proceedings (see the Campbell and Fell v. the United Kingdom judgment of 28 June 1984, Series A no. 80).
