The Court notes that it is not disputed that the surveillance of the applicant's telephone conversations in the present case amounted to an interference with his rights under Article 8 § 1 of the Convention (see, amongst others, the Klass and others v. Germany judgment of 6 September 1978, Series A no. 28, p. 21, § 40; Amman v. Switzerland [GC], no. 27798/95, § 44, ECHR 2000-II).The Court recalls that the phrase "in accordance with the law" not only requires that the impugned measure should have some basis in domestic law, but also refers to the quality of the law in question, requiring that it should be accessible to the person concerned and foreseeable as to its effects (see Amman v. Switzerland [GC], no. 27798/95, § 50, ECHR 2000-II).
