ASSOCIATION OF REAL PROPERTY OWNERS IN LÓDZ AND OTHERS v. POLAND

    Auszug aus EGMR, 08.03.2011 - 27910/07
Having regard to the decision to examine the case simultaneously with the case of The Association of Real Property Owners in Lódź (no. 3485/02), pursuant to Rule 42 § 2 of the Rules of Court,.

In view of the foregoing, in particular its assessment of the global solutions adopted by the Polish State and the redress scheme available at domestic level, the Court holds that the matter giving rise to the present application "has been resolved" for the purposes of Article 37 § 1(b) of the Convention and that it is no longer justified to continue the examination of this case (see also The Association of Real Property Owners in Lódź v. Poland (dec.) no. 3485/02, 8 March 2011, §§ 88-90, ECHR 2011-...).

    WOLKENBERG AND OTHERS v. POLAND

    Auszug aus EGMR, 08.03.2011 - 27910/07
The pilot-judgment procedure is primarily designed to assist the Contracting States in fulfilling their role in the Convention system by resolving problems at national level, thereby securing to the persons concerned their Convention rights and freedoms as required by Article 1 of the Convention, offering to them more rapid redress but also, at the same time, making it unnecessary for the Court to adjudicate on large numbers of applications similar in substance which it would otherwise have to take to judgment (see Broniowski (friendly settlement), [GC], no. 31443/06, § 35, ECHR 2005-IX; Hutten-Czapska (merits), cited above §§ 231-234; and Wolkenberg and Others v. Poland (dec.) no. 50003/99, 4 December 2007, §§ 34-35, ECHR 2007-XIV).

E.G. c. POLOGNE ET 175 AUTRES AFFAIRES DE LA RIVIÈRE BOUG

    Auszug aus EGMR, 08.03.2011 - 27910/07
Indeed, the Court's task as defined by Article 19, that is, to "ensure the observance of the engagements undertaken by the High Contracting Parties in the Convention and the Protocols thereto", is not necessarily best achieved by repeating the same findings in large series of cases (see, E.G. and 175 Other Bug River applications v. Poland (dec.), no. 50425/99, § 27, ECHR 2008-...; and Suljagic v. Bosnia and Herzegovina (no. 27912/02), § 62, ECHR 2009-...).
  • EGMR, 08.03.2011 - 3485/02
La présente affaire a pour origine les requêtes introduites par 239 propriétaires polonais dont 96 poursuivent actuellement la procédure, l'affaire liée Piotrowski c. Pologne [(déc.), no 27910/07, 8 March 2011] et 24 autres affaires semblables actuellement suspendues.
