La Cour renvoie par ailleurs à sa décision dans l'affaire D. c. Belgique (no 29176/13, 8 juillet 2017), qui concernait le refus d'autoriser l'entrée en Belgique d'un enfant né en Ukraine à l'issue d'une gestation pour autrui ; les parents d'intention, qui se plaignaient en particulier d'une violation de l'article 8 de la Convention, avaient utilisé une procédure comparable au référé-liberté de l'article L. 521-2 du code de justice administrative afin d'obtenir du juge des référés qu'il ordonne aux autorités belges de délivrer un titre de voyage permettant à l'enfant d'entrer en Belgique.
