In addition, the Court has held that the prolonged non-enforcement of a final court judgment giving rise to a "legitimate expectation" - and thus to a "possession" within the meaning of Article 1 of Protocol No. 1 - can be seen as problematic under that provision (see Ramadhi and Others v. It notes also that under Article 35(3)(a) of the Convention it may reject an application as constituting an abuse, and that this would be so, for example, in cases where the application was knowingly based on untrue facts (see, among other authorities, Varbanov v. Bulgaria, no. 31365/96, § 36, ECHR 2000-X; Akdivar and Others v. Turkey, 16 September 1996, §§ 53-54, Reports of Judgments and Decisions 1996-IV; and Kerechashvili v. Georgia (dec.), no. 5667/02, 2 May 2006).
