In such cases, in determining adequate compensation the Court must base itself on the criteria laid down in its judgments regarding Article 1 of Protocol No. 1, according to which a deprivation of property without payment of an amount reasonably related to its value would normally constitute a disproportionate interference which could not be considered justifiable under Article 1 of Protocol No. 1 (see James and Others v. the United Kingdom, 21 February 1986, § 54, Series A no. 98), and a total lack of compensation may be considered justifiable only in exceptional circumstances.
