Juni 2014, Nr. 56030/07, § 127).aa) Das Autonomierecht beinhaltet das Recht der Kirche oder Religionsgemeinschaft, nach ihren Rechtssätzen und nach ihrem Ermessen auf ein Verhalten ihrer Mitglieder zu reagieren, das eine Bedrohung für den Zusammenhalt, die Glaubwürdigkeit oder die Einheit der Gemeinschaft bedeutet (vgl. hierzu: EGMR (GK), Sindicatul "Pastorul cel Bun" v. Da den Staat insoweit hinsichtlich beider Konventionsrechte objektive Schutzpflichten treffen und der Schutz der einen Rechtsposition notwendigerweise zur Beeinträchtigung des entgegenstehenden Rechts führt, räumt der Europäische Gerichtshof für Menschenrechte den Konventionsstaaten einen weiten Einschätzungsspielraum ein (vgl. EGMR (GK), Sindicatul "Pastorul cel Bun" v. Rumänien, Urteil vom 9. Juli 2013, Nr. 2330/09, § 160; EGMR (GK), Fernández Martínez v. Spanien, Urteil vom 12. Juni 2014, Nr. 56030/07, § 123).
Dennoch werden die Konventionsstaaten ihren objektiven Schutzpflichten im Einzelfall nur gerecht, wenn sie eine eingehende und alle wesentlichen Umstände des Einzelfalls berücksichtigende Abwägung der durch die Kündigung tangierten Rechtspositionen von Arbeitgeber und Arbeitnehmer vornehmen (vgl. EGMR (GK), Sindicatul "Pastorul cel Bun" v. Rumänien, Urteil vom 9. Juli 2013, Nr. 2330/09, § 159; EGMR (GK), Fernández Martínez v. Spanien, Urteil vom 12. Juni 2014, Nr. 56030/07, § 123).
