Dans une affaire précédente, la Cour a jugé que la négligence des avocats du requérant, qui ignoraient que la peine d'emprisonnement à perpétuité de leur client avait été commuée en une peine à durée fixe et n'avaient pas prévenu la Cour de ce fait dès qu'ils en avaient eu connaissance, constituait un abus du droit de recours individuel (Bekauri c.
