FRESSOZ ET ROIRE c. FRANCE
Auszug aus EGMR, 10.05.2007 - 37685/02
The Court reiterates the basic principles laid down in its judgments concerning Article 10 (see, in particular, the following judgments, Sener v. Turkey, no. 26680/95, §§ 39-43, 18 July 2000, Ä°brahim Aksoy, cited above, §§ 51-53, Lingens v. Austria, judgment of 8 July 1986, Series A no. 103, p. 26, §§ 41-42, and Fressoz and Roire v. France [GC], no. 29183/95, § 45, ECHR 1999). - EGMR, 08.07.1999 - 23168/94
KARATAS c. TURQUIE
Auszug aus EGMR, 10.05.2007 - 37685/02
The Court takes into account, furthermore, the background to cases submitted to it, particularly problems linked to the prevention of terrorism (see Karakas v. Turkey [GC], no. 23168/94, § 54, ECHR 1999-IV). - EGMR, 08.07.1999 - 23536/94

Auszug aus EGMR, 10.05.2007 - 37685/02
The relevant domestic law and practice in force at the material time are outlined in the following judgments: ErdoÄ?du v. Turkey (no. 25723/94, §§ 21-26, ECHR 2000-VI), and Baskaya and OkçuoÄ?lu v. Turkey ([GC], nos. 23536/94 and 24408/94, §§ 25-27, ECHR 1999-IV).

GERGER v. TURKEY
Auszug aus EGMR, 10.05.2007 - 37685/02
In the Court's view, this is an essential consideration (contrast Sürek v. Turkey (no. 1), cited above, § 62, and Gerger v. Turkey [GC], no. 24919/94, § 50, 8 July 1999) in the assessment of the necessity of the measure. - EGMR, 08.07.1999 - 26682/95
SÜREK c. TURQUIE (N° 1)
Auszug aus EGMR, 10.05.2007 - 37685/02
Reiterating that there is little scope under Article 10 § 2 of the Convention for restrictions on political speech or the debate on questions of public interest (see Sürek v. Turkey (no. 1) [GC], no. 26682/95, § 61, ECHR 1999-IV), the Court finds that, although the passages highlighted by the prosecution do give the narrative a hostile tone, they do not encourage violence, armed resistance or insurrection, and do not constitute hate speech. - EGMR, 18.07.2000 - 26680/95
SENER v. TURKEY

SAKHNOVSKI c. RUSSIE
Dans le contexte des garanties offertes par l'article 6 sous son volet pénal, un acquittement ou un non-lieu ont été considérés comme un redressement adéquat (voir, par exemple, Carboni c. Italie (déc.), no 51554/99, 12 février 2004 ; Üstün c. Turquie, no 37685/02, 10 mai 2007, § 24, et Oleksy c. Pologne (déc.), no 1379/06, 16 juin 2009). - EGMR, 05.07.2022 - 42315/15
DROUSIOTIS v. CYPRUS
In this connection, the Court observes that the expressions used in the article were essentially made up of value judgments and not concrete statements of fact (compare, for example, Üstün v. Turkey, no. 37685/02, §§ 9 and 32, 10 May 2007, and Tusalp v. Turkey, nos. 32131/08 and 41617/08, §§ 17, 21, 22 and 47, 21 February 2012; see also Balaskas, cited above, §§ 54-55, concerning the characterisation of a headmaster as a "well-known neo-Nazi"). - EGMR, 02.12.2014 - 42733/07
GIUTTARI c. ITALIE
Turquie, no 37685/02, § 24, 10 mai 2007 ; Komyakov c. Russie (déc.), no 7100/02, 8 janvier 2009 ; Sharomov c. Russie, no 8927/02, § 36, 15 janvier 2009 ; et Oleksy c. Pologne (déc.), no 1379/06, 16 juin 2009).
- EGMR, 03.12.2013 - 6840/11
B.H. c. FRANCE
Turquie, no 37685/02, § 24, 10 mai 2007 ; Sharomov c. Russie, no 8927/02, § 36, 15 janvier 2009 ; Komyakov c. Russie (déc.), no 7100/02, 8 janvier 2009, et Oleksy c. Pologne (déc.), no 1379/06, 16 juin 2009). - EGMR, 13.12.2007 - 47520/99
AKiN BIRDAL c. TURQUIE
La Cour a examiné les motifs figurant dans les décisions des juridictions internes, qui ne sauraient être considérés comme suffisant à justifier l'ingérence dans le droit du requérant à la liberté d'expression (voir, mutatis mutandis, Sürek c. Turquie (no 4) [GC], no 24762/94, § 58, 8 juillet 1999, et Üstün c. Turquie, no 37685/02, §§ 34-35, 10 mai 2007). - EGMR, 02.10.2007 - 53047/99
BIRDAL v. TURKEY
Against this background, the Court considers that the reasons given by the State Security Court for convicting and sentencing the applicant, cannot be considered sufficient to justify the interference with the applicant's right to freedom of expression (see, mutatis mutandis, Sürek v. Turkey (no. 4) [GC], no. 24762/94, § 58, 8 July 1999 and Üstün v. Turkey, no. 37685/02, §§ 34-35, 10 May 2007).
